    1                        A bill to be entitled                      
    2         An act relating to inmate reports; amending s.
    3         945.041, F.S.; revising the information the Department
    4         of Corrections is required to publish on its website
    5         and update quarterly to include information from each
    6         facility regarding health services and conditions, the
    7         use of force, reports of abuse, disciplinary reports,
    8         the death of inmates, and statistics related to
    9         specified officer classes; reenacting s. 20.315(5),
   10         F.S., relating to the creation of the department;
   11         providing an effective date.
   12          
   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Subsection (3) is added to section 945.041,
   16  Florida Statutes, to read:
   17         945.041 Reports.—The department shall publish on its
   18  website and make available to the public the following
   19  information, updated on a quarterly basis:
   20         (3) For each facility, all of the following information:
   21         (a)The average number of days between an inmate’s request
   22  for medical services and his or her receipt of such services.
   23         (b) Information related to outbreaks of communicable
   24  diseases, including the date on which the outbreak was initially
   25  discovered, the number of inmates and staff impacted by the
   26  outbreak, and the date on which the outbreak was resolved.
   27         (c) The number of incidents involving use of force.
   28         (d) The number of abuse complaints.
   29         (e) The number of disciplinary reports written, including
   30  the basis for the violations.
   31         (f) The specific causes of death for inmates who are in the
   32  custody of the department at the time of their death. The
   33  information must include incidents in which the actions directly
   34  contributing to the inmate’s death initiated in a facility, even
   35  if the inmate’s death occurred outside the facility.
   36         (g) The number of inmate suicides.
   37         (h) The average monthly temperature inside each dorm.
   38         (i) For each class of officer, including correctional
   39  officers, correctional officer sergeants, correctional officer
   40  lieutenants, and correctional officer captains:
   41         1. The ratio of inmates to each class.
   42         2. The average number of years of employment held by
   43  members of the class.
   44         3. The attrition rate for each class.
   45         Section 2. For the purpose of incorporating the amendment
   46  made by this act to section 945.041, Florida Statutes, in a
   47  reference thereto, subsection (5) of section 20.315, Florida
   48  Statutes, is reenacted to read:
   49         20.315 Department of Corrections.—There is created a
   50  Department of Corrections.
   51         (5) ANNUAL REPORTING.—The department shall report annually
   52  to the Governor, the President of the Senate, and the Speaker of
   53  the House of Representatives recounting its activities and
   54  making recommendations for improvements to the performance of
   55  the department. The annual report shall include information
   56  published under s. 945.041.
   57         Section 3. This act shall take effect July 1, 2020.
