Subsection (5) is added to section 373.229, 11 Florida Statutes, to read: 12 373.229 Application for permit.— 13 (5) Notwithstanding s. 373.109, the governing board of a 14 water management district shall charge a fee of at least $1 15 million for a consumptive use permit to directly or indirectly 16 use water derived from a spring for bottled drinking water. The 17 water management district shall use the funds received under 18 this subsection for springs restoration, which includes 19 implementation of projects that improve water quality, recharge 20 flow, and protect habitat in any spring system within the 21 district. As used in this subsection, the terms: 22 (a) “Bottled drinking water” means all water that is sealed 23 in bottles, packages, or other containers and offered for sale 24 for human consumption, including bottled mineral water. 25 (b) “Water derived from a spring” means water derived from 26 an underground formation from which water flows naturally to the 27 surface of the earth in the manner described in 21 C.F.R. 28 165.110(a)(2)(vi). 29 Section 2. This act shall take effect July 1, 2020.
