    1                        A bill to be entitled                      
    2         An act relating to student health services; providing
    3         a short title; creating s. 1006.064, F.S.; defining
    4         the terms “feminine hygiene products” and “school
    5         building”; requiring school districts to make feminine
    6         hygiene products available, at no charge, in female
    7         restroom facilities of public school buildings;
    8         providing applicability; providing an effective date.
    9  
   10         WHEREAS, feminine hygiene products are a health care
   11  necessity and are not items that can be foregone or substituted
   12  easily, and
   13         WHEREAS, access to feminine hygiene products is a serious
   14  and ongoing need in this state, and
   15         WHEREAS, when students do not have access to affordable
   16  feminine hygiene products, they may miss multiple days of school
   17  every month, and
   18         WHEREAS, when students have access to quality feminine
   19  hygiene products, they are able to continue with their daily
   20  lives with minimal interruption, NOW, THEREFORE,
   21  
   22  Be It Enacted by the Legislature of the State of Florida:
   23  
   24         Section 1. This act may be cited as the “Learning with
   25  Dignity Act.”
   26         Section 2. Section 1006.064, Florida Statutes, is created
   27  to read:
   28         1006.064 Availability of feminine hygiene products.—
   29         (1)As used in this section, the term:
   30         (a)“Feminine hygiene products” means tampons and sanitary
   31  napkins for use in connection with the menstrual cycle.
   32         (b)“School building” means any facility:
   33         1.That is owned or leased by a school district or over
   34  which the school board has care, custody, and control; and
   35         2.In which there is a public school serving students in
   36  grades K-12.
   37         (2)A school district shall make feminine hygiene products
   38  available, at no charge, in female restroom facilities of school
   39  buildings.
   40         (3)This section applies to charter schools pursuant to s.
   41  1002.33(16)(a)5.
   42         Section 3. This act shall take effect July 1, 2020.
