1 A bill to be entitled
2 An act relating to prior authorization for opioid
3 alternatives; amending s. 627.64195, F.S.; prohibiting
4 health insurance policies from requiring that
5 treatment with an opioid analgesic drug product be
6 attempted and have failed before authorizing the use
7 of a nonopioid-based analgesic drug product; providing
8 an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (2) of section 627.64195, Florida
13 Statutes, is amended to read:
14 627.64195 Requirements for opioid coverage.—
15 (2) COVERAGE REQUIREMENTS.—
16 (a) A health insurance policy may not require that
17 treatment with an opioid analgesic drug product be attempted and
18 have failed before authorizing the use of a nonopioid-based
19 analgesic drug product.
20 (b) A health insurance policy that provides coverage for
21 abuse-deterrent opioid analgesic drug products:
22 1.(a) May impose a prior authorization requirement for an
23 abuse-deterrent opioid analgesic drug product only if the policy
24 imposes the same prior authorization requirement for each opioid
25 analgesic drug product without an abuse-deterrence labeling
26 claim.
27 2.(b) May not require use of an opioid analgesic drug
28 product without an abuse-deterrence labeling claim before
29 authorizing the use of an abuse-deterrent opioid analgesic drug
30 product.
31 Section 2. This act shall take effect January 1, 2021.
