4 insert:
5 (b) If an infant is born alive during or immediately after
6 an attempted abortion, any health care practitioner present at
7 the time shall humanely exercise the same degree of professional
8 skill, care, and diligence to preserve the life and health of
9 the infant as a reasonably diligent and conscientious health
10 care practitioner would render to an infant born alive at the
11 same gestational age in the course of natural birth. If the
12 physician performing the procedure determines that, in his or
13 her reasonable medical judgment, it is unlikely that the infant
14 born alive will survive due to his or her medical condition, the
15 physician, with the informed consent and signature of the
16 pregnant mother, may issue a physician’s order not to
17 resuscitate the infant.
