Floor: 24/F/2R . 01/29/2020 05:10 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Berman moved the following: 1 Senate Amendment (with title amendment) 2 3 Between lines 284 and 285 4 insert: 5 (9) MATERIALS AND INFORMATION.— 6 (a) The Office of the State Courts Administrator shall 7 develop and publish materials informing the public of the 8 procedures for judicial waiver under this subsection. The 9 materials must be published in hard copy format and posted on 10 the Office of the State Courts Administrator’s website on the 11 webpage provided in paragraph (c) in an easily downloadable 12 format. The materials must include information that is stated in 13 plain, easily understandable language corresponding to a grade 5 14 reading level and must include all of the following information: 15 1. An explanation that a minor who is unable to obtain 16 parental consent or a waiver of parental notification for an 17 abortion may petition a circuit court to obtain a judicial 18 waiver. 19 2. A statement that any information that could be used to 20 identify a minor who petitions the court for a judicial waiver 21 is confidential and exempt from public disclosure, that judges 22 and court staff must maintain that confidentiality, and that any 23 personal identifying information contained in a court record 24 must be kept confidential. 25 3. A step-by-step guide detailing the procedures for 26 obtaining a judicial waiver, from the initiation of a petition 27 for judicial waiver to a court’s final ruling, and, if 28 applicable, by county, an expected timeline for proceedings; 29 where the minor can locate and obtain materials, physically or 30 online; where and how a petition and any necessary paperwork may 31 be filed; and a list of important deadlines. 32 4. A list of each county’s clerk of the court, including 33 addresses, office hours, and the direct contact information for 34 a staff member who is familiar with the judicial waiver 35 procedures in a particular circuit’s jurisdiction. 36 5. Information about how to access the names and contact 37 information for attorneys who provide services on a pro bono 38 basis to minors seeking a judicial waiver. 39 6. Information about the evidentiary standard that the 40 court is required to use when deciding whether to grant or deny 41 a judicial waiver, including a list of evidence the minor must 42 provide to the court during the hearing. 43 (b) The Office of the State Courts Administrator must 44 provide an adequate amount of published materials in hard copy 45 format to each clerk of the court and to each health care 46 provider that offers abortion services which include all of the 47 information required in subparagraph 1. regarding judicial 48 waiver procedures. 49 (c) The Office of the State Courts Administrator must 50 publish a clearly visible hyperlink on its website which directs 51 the public to a stand-alone webpage. The webpage may not share a 52 uniform resource locator (URL) with any other information and 53 must contain all of the information required in subparagraph 1. 54 The hyperlink to the URL must clearly identify that it provides 55 information regarding the judicial waiver procedures for a minor 56 who is seeking to obtain an abortion without parental consent or 57 notification. 58 (d) At least annually, the Office of the State Courts 59 Administrator must review and, if necessary, update the 60 materials and information required under this subsection for 61 accuracy, including all contact information for the clerks of 62 the court and the courthouses where a minor may file a petition 63 for a judicial waiver. 64 65 ================= T I T L E A M E N D M E N T ================ 66 And the title is amended as follows: 67 Delete line 18 68 and insert: 69 made by the act; requiring the Office of the State 70 Courts Administrator to develop and publish certain 71 informational materials in hard copy format and online 72 regarding procedures for obtaining judicial waivers; 73 prescribing the format and content of the materials; 74 providing for the distribution of the materials; 75 requiring the office to publish a clearly visible 76 website hyperlink to a specified webpage containing 77 certain information on judicial waivers; requiring the 78 office to annually review and update, as necessary, 79 the informational materials, including certain 80 specified information; amending s. 27.511, F.S.; 81 conforming
