Floor: NC/2R . 03/11/2020 05:54 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Thurston moved the following: 1 Senate Amendment to Amendment (253764) (with title 2 amendment) 3 4 Between lines 225 and 226 5 insert: 6 (c) Pursuant to paragraph (b), the department shall 7 maintain a waiting list of new specialty license plates in 8 sequential order which have been approved by the Legislature 9 pursuant to this section. The following specialty license 10 plates, in sequential order, are approved for design and 11 issuance as plates are discontinued pursuant to paragraph (b), 12 not to exceed 150 plates: 13 1. Divine Nine License Plates.— 14 a. The Divine Nine license plate must bear the colors and 15 design approved by the department and must include the official 16 logo as appropriate for each organization. The word “Florida” 17 must appear at the top of the plate, and the word “Divine” must 18 appear at the bottom of the plate. 19 b. The annual use fees from the sale of the plate shall be 20 distributed as follows: 21 (I) Five percent of the proceeds shall be distributed to 22 the United Negro College Fund, Inc., for college scholarships 23 for Florida residents attending Florida’s historically black 24 colleges and universities. 25 (II) The remaining 95 percent of the proceeds shall be 26 distributed to one of the following organizations as selected by 27 the purchaser of the plate who shall receive a license plate 28 with the design associated with the appropriate recipient 29 organization: 30 (A) Alpha Phi Alpha Fraternity, Inc. 31 i. Eighty-five percent shall be distributed to the Florida 32 Federation of Alpha Chapters, Inc., to promote community 33 awareness and action through educational, economic, and cultural 34 service activities within this state. 35 ii. Ten percent shall be distributed to the Florida 36 Federation of Alpha Chapters, Inc., solely for the marketing of 37 the plate. 38 (B) Alpha Kappa Alpha Sorority, Inc. 39 i. Eighty-five percent shall be distributed to the Alpha 40 Kappa Alpha Educational Advancement Foundation, Inc., to promote 41 community awareness and action through educational, economic, 42 and cultural service activities within this state. 43 ii. Ten percent shall be distributed to the Alpha Kappa 44 Alpha Educational Advancement Foundation, Inc., solely for the 45 marketing of the plate. 46 (C) Kappa Alpha Psi Fraternity, Inc. 47 i. Eighty-five percent shall be distributed to the Southern 48 Province of Kappa Alpha Psi Fraternity, Inc., to promote 49 community awareness and action through educational, economic, 50 and cultural service activities within this state. 51 ii. Ten percent shall be distributed to the Southern 52 Province of Kappa Alpha Psi Fraternity, Inc., solely for the 53 marketing of the plate. 54 (D) Omega Psi Phi Fraternity, Inc. 55 i. Eighty-five percent shall be distributed to the State of 56 Florida Omega Friendship Foundation, Inc., to promote community 57 awareness and action through educational, economic, and cultural 58 service activities within this state. 59 ii. Ten percent shall be distributed to the State of 60 Florida Omega Friendship Foundation, Inc., solely for the 61 marketing of the plate. 62 (E) Delta Sigma Theta Sorority, Inc. 63 i. Eighty-five percent shall be distributed to the Delta 64 Research and Educational Foundation, Inc., to promote community 65 awareness and action through educational, economic, and cultural 66 service activities within this state. 67 ii. Ten percent shall be distributed to the Delta Research 68 and Educational Foundation, Inc., solely for the marketing of 69 the plate. 70 (F) Phi Beta Sigma Fraternity, Inc. 71 i. Eighty-five percent shall be distributed to the TMB 72 Charitable Foundation, Inc., to promote community awareness and 73 action through educational, economic, and cultural service 74 activities within this state. 75 ii. Ten percent shall be distributed to the TMB Charitable 76 Foundation, Inc., solely for the marketing of the plate. 77 (G) Zeta Phi Beta Sorority, Inc. 78 i. Eighty-five percent shall be distributed to the Florida 79 Pearls, Inc., to promote community awareness and action through 80 educational, economic, and cultural service activities within 81 this state. 82 ii. Ten percent shall be distributed to the Florida Pearls, 83 Inc., solely for the marketing of the plate. 84 (H) Sigma Gamma Rho Sorority, Inc. 85 i. Eighty-five percent shall be distributed to the Sigma 86 Gamma Rho Sorority National Education Fund, Inc., to promote 87 community awareness and action through educational, economic, 88 and cultural service activities within this state. 89 ii. Ten percent shall be distributed to the Sigma Gamma Rho 90 Sorority National Education Fund, Inc., solely for the marketing 91 of the plate. 92 (I) Iota Phi Theta Fraternity, Inc. 93 i. Eighty-five percent shall be distributed to the National 94 Iota Foundation, Inc., to promote community awareness and action 95 through educational, economic, and cultural service activities 96 within this state. 97 ii. Ten percent shall be distributed to the National Iota 98 Foundation, Inc., solely for the marketing of the plate. 99 2. Palm beach zoo and conservation society license plates.— 100 a. The Palm Beach Zoo and Conservation Society license 101 plates must bear the colors and design approved by the 102 department. The word “Florida” must appear at the top of the 103 plate, and the words “Palm Beach Zoo and Conservation Society” 104 must appear at the bottom of the plate. 105 b. The license plate annual use fees shall be distributed 106 to the Palm Beach Zoo and Conservation Society to fund 107 educational programs for students in pre-K through grade 12, 108 conservation projects to protect endangered or threatened 109 species, and services for the health and welfare of animals in 110 the zoo’s care. The Palm Beach Zoo and Conservation Society may 111 retain all revenue from the annual use fees until all startup 112 costs for developing and establishing the plate have been 113 recovered. Thereafter, up to 10 percent of the annual use fee 114 revenue may be used for promotion and marketing of the specialty 115 license plate and administrative costs directly associated with 116 the programs of the society and the specialty license plate. 117 3. Solar power license plates.— 118 a. The Solar Power license plate must bear the colors and 119 design approved by the department. The word “Florida” must 120 appear at the top of the plate, and the words “Powered by the 121 Sun” must appear at the bottom of the plate. 122 b. The annual fees from the sale of the plate must be 123 distributed to the Florida Solar Energy Research and Education 124 Foundation, Inc., a nonprofit Florida corporation under s. 125 501(c)(3) of the Internal Revenue Code, to fund programs which 126 support greater employment opportunities and job training 127 programs that promote the growth of the solar energy industry in 128 Florida. Up to 10 percent of the proceeds may be used for 129 administrative costs and to promote and market the plate. 130 4. Morehouse college license plates.— 131 a. The Morehouse College license plate must bear the colors 132 and design approved by the department. The word “Florida” must 133 appear at the top of the plate, and the words “Morehouse 134 College” must appear at the bottom of the plate. 135 b. The annual use fees from the sale of the plate shall be 136 distributed to the Morehouse College Alumni Association of 137 Broward County, which must use the proceeds for the purpose of 138 awarding scholarships to Florida residents attending Morehouse 139 College. The proceeds must be deposited in the endowment 140 required in s. 320.08056(12). Students receiving these 141 scholarships must be eligible for the Florida Bright Futures 142 Scholarship Program pursuant to s. 1009.531 and shall use the 143 scholarship funds for tuition and other expenses related to 144 attending Morehouse College. 145 5. Margaritaville license plates.— 146 a. The Margaritaville license plate must bear the colors 147 and design approved by the department. The word “Florida” must 148 appear at the top of the plate, and the word “Margaritaville” 149 must appear at the bottom of the plate. 150 b. The annual use fees must be distributed to the SFC 151 Charitable Foundation, Inc., a Florida nonprofit corporation 152 doing business as the Singing for Change Foundation, to fund its 153 activities, programs, and projects. The Singing for Change 154 Foundation shall retain all revenue from the annual use fees 155 until all startup costs for developing and establishing the 156 plate have been recovered. 157 c. Thereafter, the annual use fees shall be distributed as 158 follows: 159 (I) Up to 10 percent of the annual use fee revenue may be 160 used for administration, promotion, and marketing of the 161 specialty license plate. 162 (II) The remaining proceeds must be used by the Singing for 163 Change Foundation for its educational, economic, and cultural 164 programs that assist local communities impacted by natural and 165 manmade disasters with recovery, rebuilding, and future 166 sustainability efforts, and that promote and inspire local 167 grassroots leadership that works to improve the quality of life 168 in those communities and other communities in this state. 169 170 ================= T I T L E A M E N D M E N T ================ 171 And the title is amended as follows: 172 Delete line 1528 173 and insert: 174 specialty license plate; requiring the department to 175 maintain a waiting list of new specialty license 176 plates; providing that specified specialty license 177 plates are approved for design and issuance; amending 178 s. 320.08056, F.S.;
