Florida Senate - 2020 SB 416 By Senator Berman 31-00618-20 2020416__ 1 A bill to be entitled 2 An act relating to insurance coverage for breast 3 cancer tests and procedures; creating ss. 627.42394 4 and 641.3133, F.S.; providing definitions; prohibiting 5 cost-sharing requirements for specified breast cancer 6 tests and procedures under individual health insurance 7 policies, group, blanket, and franchise health 8 insurance policies, and health maintenance contracts; 9 authorizing the Financial Services Commission to adopt 10 rules; providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 627.42394, Florida Statutes, is created 15 to read: 16 627.42394 Coverage for diagnostic mammograms, breast 17 magnetic resonance imaging scans, and breast ultrasounds.— 18 (1) As used in this section, the term: 19 (a) “Cost sharing” has the same meaning as provided in s. 20 627.42391. 21 (b) “Health care provider” means a physician licensed under 22 chapter 458 or chapter 459, a physician assistant licensed under 23 chapter 458 or chapter 459, and an advanced practice registered 24 nurse licensed under chapter 464. 25 (2) An individual or group, blanket, or franchise health 26 insurance policy delivered, issued for delivery, renewed, 27 amended, or continued in this state that provides coverage for 28 diagnostic mammograms, breast magnetic resonance imaging scans, 29 or breast ultrasounds may not apply cost-sharing requirements 30 for a diagnostic mammogram, breast magnetic resonance imaging 31 scan, or breast ultrasound, respectively, that is ordered by a 32 health care provider. 33 (3) The commission may adopt rules to administer this 34 section. 35 Section 2. Section 641.3133, Florida Statutes, is created 36 to read: 37 641.3133 Coverage for diagnostic mammograms, breast 38 magnetic resonance imaging scans, and breast ultrasounds.— 39 (1) As used in this section, the term: 40 (a) “Cost sharing” has the same meaning as provided in s. 41 641.313. 42 (b) “Health care provider” means a physician licensed under 43 chapter 458 or chapter 459, a physician assistant licensed under 44 chapter 458 or chapter 459, and an advanced practice registered 45 nurse licensed under chapter 464. 46 (2) A health maintenance contract delivered, issued for 47 delivery, renewed, amended, or continued in this state that 48 provides coverage for diagnostic mammograms, breast magnetic 49 resonance imaging scans, or breast ultrasounds may not apply 50 cost-sharing requirements for a diagnostic mammogram, breast 51 magnetic resonance imaging scan, or breast ultrasound, 52 respectively, that is ordered by a health care provider. 53 Section 3. This act shall take effect January 1, 2021.
