House Comm: RCS . 02/04/2020 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Commerce and Tourism (Albritton) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 1932 - 1943 4 and insert: 5 licenses, registrations, permits, and fees is preempted to the 6 state. A municipality, county, or other local governmental 7 entity may not require a separate license, registration, or 8 permit other than the license required under s. 509.241, or 9 require the payment of any license, registration, or permit fee 10 other than the fee required under s. 509.251, as a condition for 11 the operation of a mobile food dispensing vehicle within the 12 entity’s jurisdiction. A municipality, county, or other local 13 governmental entity may not prohibit mobile food dispensing 14 vehicles from operating within the entirety of the entity’s 15 jurisdiction. 16 (3) This section may not be construed to affect a 17 municipality, county, or other local governmental entity’s 18 authority to regulate the operation of mobile food dispensing 19 vehicles other than the regulations described in subsection (2). 20 21 ================= T I T L E A M E N D M E N T ================ 22 And the title is amended as follows: 23 Delete lines 188 - 190 24 and insert: 25 s. 509.102; defining the term “mobile food dispensing 26 vehicle”; preempting certain regulation of mobile food 27 dispensing vehicles to the state; prohibiting certain 28 entities from prohibiting mobile food dispensing 29 vehicles from operating within the entirety of such 30 entities’ jurisdictions; providing construction; 31 amending s. 548.003,
