Florida Senate - 2020 SB 52 By Senator Bean 4-01795A-20 202052__ 1 A bill to be entitled 2 An act relating to Medicaid services; amending s. 3 409.904, F.S.; deleting the expiration of a 4 requirement for the Agency for Health Care 5 Administration to make payments for Medicaid-covered 6 services for certain persons based on specified 7 retroactive eligibility timeframes; providing an 8 effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Subsection (12) of section 409.904, Florida 13 Statutes, is amended to read: 14 409.904 Optional payments for eligible persons.—The agency 15 may make payments for medical assistance and related services on 16 behalf of the following persons who are determined to be 17 eligible subject to the income, assets, and categorical 18 eligibility tests set forth in federal and state law. Payment on 19 behalf of these Medicaid eligible persons is subject to the 20 availability of moneys and any limitations established by the 21 General Appropriations Act or chapter 216. 22 (12) Effective July 1, 2019, the agency shall make payments 23 fortoMedicaid-covered services: 24 (a) For eligible children and pregnant women, retroactive 25 for a period of no more than 90 days before the month in which 26 an application for Medicaid is submitted. 27 (b) For eligible nonpregnant adults, retroactive to the 28 first day of the month in which an application for Medicaid is 29 submitted. 30 31This subsection expires July 1, 2020.32 Section 2. This act shall take effect July 1, 2020.
