(Hooper) recommended the following:

6 Section 1. Subsection (5) of section 40.29, Florida
7 Statutes, is amended to read:
8 40.29 Payment of due-process costs.—
9 (5) The Justice Administrative Commission shall provide
10 funds to the clerks of the court to compensate jurors, to pay
11 for meals or lodging provided to jurors, and to pay for jury
12 related personnel costs as provided in this section. Each clerk
13 of the court shall submit a request for reimbursement forward to
14 the Florida Clerks of Court Operations Corporation within 20
15 days after each quarter attesting to the clerk’s actual costs
16 Justice Administrative Commission a quarterly estimate of funds
17 necessary to compensate jurors, to and pay for meals or lodging
18 provided to jurors, and to pay for jury-related personnel costs
19 during the upcoming quarter. The Florida Clerks of Court
20 Operations Corporation shall review the request for
21 reimbursement to ensure that the costs are reasonably and
22 directly related to jury management. The Florida Clerks of Court
23 Operations Corporation shall forward to the Justice
24 Administrative Commission a quarterly estimate of the amount
25 necessary to reimburse each clerk of the court for its personnel
26 and other costs related to jury management unless the total
27 request for reimbursement by the clerks exceeds the quarterly
28 funds available to the Justice Administrative Commission, in
29 which case the Florida Clerks of Court Operations Corporation
30 shall adjust the cumulative total to match the available funds
31 before submitting the request to the Justice Administrative
32 Commission. Upon receipt of each request for reimbursement such
33 estimates, the Justice Administrative Commission shall review
34 determine the amount deemed necessary for payment to the clerks
35 of the court for the most recently completed during the upcoming
36 quarter, determine if the total payment amount is available, and
37 submit a request for payment to the Chief Financial Officer. If
38 the Justice Administrative Commission believes that the amount
39 appropriated by the Legislature is insufficient to meet such
40 costs during the remaining part of the state fiscal year, the
41 commission may apportion the funds appropriated in the General
42 Appropriations Act for those purposes among the several
43 counties, basing the apportionment upon the amount expended for
44 such purposes in each county during the prior fiscal year, in
45 which case, the Chief Financial Officer shall issue the
46 appropriate apportioned amount by warrant to each county. The
47 clerks of the court are responsible for any compensation to
48 jurors, for payments for meals or lodging provided to jurors,
49 and for jury-related personnel costs that exceed the funding
50 provided in the General Appropriations Act for these purposes.
51 Section 2. This act shall take effect July 1, 2020.

64 for reimbursement; requiring the corporation to submit
65 certain information to the commission; requiring the
66 commission to review the information and submit a
67 request for payment to the Chief Financial Officer
68 under certain circumstances; removing a provision
69 authorizing the commission to apportion funds among
70 the counties for certain purposes; providing an
71 effective date.
