5 Section 1. Subsection (5) of section 40.29, Florida
6 Statutes, is amended to read:
7 40.29 Payment of due-process costs.—
8 (5) The Justice Administrative Commission shall provide
9 funds to the clerks of the court to compensate jurors, to pay
10 for meals or lodging provided to jurors, and to pay for jury
11 related personnel and operational costs as provided in this
12 section. Each clerk of the court shall submit a request for
13 reimbursement forward to the Florida Clerks of Court Operations
14 Corporation within 20 days after each quarter attesting to the
15 clerk’s actual costs Justice Administrative Commission a
16 quarterly estimate of funds necessary to compensate jurors, to
17 and pay for meals or lodging provided to jurors, and to pay for
18 jury-related personnel and operational costs during the upcoming
19 quarter. The Florida Clerks of Court Operations Corporation
20 shall review the request for reimbursement to ensure that the
21 costs are reasonably and directly related to jury management.
22 The Florida Clerks of Court Operations Corporation shall forward
23 to the Justice Administrative Commission a quarterly estimate of
24 the amount necessary to reimburse each clerk of the court unless
25 the total request for reimbursement by the clerks exceeds the
26 quarterly funds available to the Justice Administrative
27 Commission, in which case the Florida Clerks of Court Operations
28 Corporation shall adjust the cumulative total to match the
29 available funds before submitting the request to the Justice
30 Administrative Commission for its personnel and other costs
31 related to jury management. Upon receipt of each request for
32 reimbursement such estimates, the Justice Administrative
33 Commission shall review determine the amount deemed necessary
34 for payment to the clerks of the court for the most recently
35 completed during the upcoming quarter, determine if the total
36 payment amount is available, and submit a request for payment to
37 the Chief Financial Officer. If the Justice Administrative
38 Commission believes that the amount appropriated by the
39 Legislature is insufficient to meet such costs during the
40 remaining part of the state fiscal year, the commission may
41 apportion the funds appropriated in the General Appropriations
42 Act for those purposes among the several counties, basing the
43 apportionment upon the amount expended for such purposes in each
44 county during the prior fiscal year, in which case, the Chief
45 Financial Officer shall issue the appropriate apportioned amount
46 by warrant to each county. The clerks of the court are
47 responsible for any compensation to jurors, for payments for
48 meals or lodging provided to jurors, and for jury-related
49 personnel and operational costs that exceed the funding provided
50 in the General Appropriations Act for these purposes.
51 Reimbursements under this subsection are not subject to s.
52 215.97 or s. 215.985.
53 Section 2. This act shall take effect July 1, 2020.

65 reimbursement for jury-related costs to the Clerks of
66 Court Operations Corporation within specified
67 timeframes; requiring the Florida Clerks of Court
68 Operations Corporation to review the requests for
69 reimbursement; requiring the corporation to submit
70 certain information to the commission; requiring the
71 commission to review the information and submit a
72 request for payment to the Chief Financial Officer
73 under certain circumstances; removing a provision
74 authorizing the commission to apportion funds among
75 the counties for certain purposes; revising the types
76 of costs that the clerks of the court are responsible
77 for that exceed funding provided in the General
78 Appropriations Act; providing construction; providing
79 an effective date.
