Florida Senate - 2020 CS for SB 652 By the Committee on Criminal Justice; and Senator Pizzo 591-02747-20 2020652c1 1 A bill to be entitled 2 An act relating to the Urban Core Gun Violence Task 3 Force; creating s. 943.6872, F.S.; creating the Urban 4 Core Gun Violence Task Force; requiring the task force 5 to comply with specified requirements; providing for 6 membership; providing for staff support; providing 7 requirements for meetings; specifying duties and 8 powers of the task force; authorizing the task force 9 to seek assistance from state agencies; providing for 10 access to certain information and records; requiring 11 an initial report; authorizing annual reports; 12 providing for repeal of the task force; providing an 13 effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. Section 943.6872, Florida Statutes, is created 18 to read: 19 943.6872 Urban Core Gun Violence Task Force.— 20 (1) The Urban Core Gun Violence Task Force, a task force as 21 defined in s. 20.03, is created within the Department of Law 22 Enforcement. Except as otherwise provided in this section, the 23 task force shall comply with the requirements of s. 20.052. 24 (2)(a) The 10-member task force shall convene no later than 25 September 1, 2020, and must be composed of 2 members appointed 26 by each of the following: the President of the Senate, the 27 Minority Leader of the Senate, the Speaker of the House of 28 Representatives, the Minority Leader of the House of 29 Representatives, and the Governor. Appointments must be made by 30 August 1, 2020. The Governor shall appoint a chair from among 31 the members. Members serve at the pleasure of the officer who 32 appointed them. A vacancy on the task force must be filled in 33 the same manner as the original appointment. At least five of 34 the task force members must be women and at least six must be 35 members of racial minority groups. 36 (b) The General Counsel of the Department of Law 37 Enforcement shall serve as the general counsel for the task 38 force. 39 (c) The chair shall assign staff from the Department of Law 40 Enforcement and the Department of Juvenile Justice to assist the 41 task force in performing its duties. 42 (d) The task force shall meet on a quarterly basis or at 43 the call of the chair, as necessary to conduct its work, at a 44 time and location in this state designated by the chair. The 45 task force may not conduct its meetings through teleconferences 46 or other similar means. 47 (3) The task force shall investigate system failures and 48 the causes of high crime rates and gun violence incidents in 49 urban core neighborhoods and communities. In addition, the task 50 force shall develop recommendations for solutions, programs, 51 services, and strategies for improved interagency communications 52 between local and state government agencies which will help 53 facilitate the reduction of crime and gun violence in urban core 54 neighborhoods and communities. 55 (4) The task force may call upon appropriate state 56 government agencies for such professional assistance as may be 57 needed in the discharge of its duties, and such agencies shall 58 provide such assistance in a timely manner. 59 (5) Notwithstanding any other law to the contrary, the task 60 force may request and shall be provided with access to any 61 information or records that pertain to crime and gun violence 62 incidents in this state’s urban core neighborhoods and 63 communities. Information or records obtained by the task force 64 which are otherwise exempt or confidential and exempt shall 65 retain such exempt or confidential and exempt status, and the 66 task force may not disclose any such information or records. 67 (6) The task force shall submit an initial report on its 68 findings and recommendations to the Governor, the President of 69 the Senate, and the Speaker of the House of Representatives by 70 January 1, 2021, and may issue reports annually thereafter. 71 (7) This section is repealed on December 31, 2025. 72 Section 2. This act shall take effect July 1, 2020.
