    1                        A bill to be entitled                      
    2         An act relating to illegal taking and possession of
    3         bears; creating s. 379.4041, F.S.; prohibiting certain
    4         taking and possession of bears; providing penalties;
    5         providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Section 379.4041, Florida Statutes, is created
   10  to read:
   11         379.4041 Illegal taking and possession of bears.—A person
   12  who takes a bear or possesses a freshly killed bear during the
   13  closed season prescribed by law or rules of the commission
   14  commits a Level Three violation under s. 379.401 and forfeits
   15  any license or permit issued to him or her under this chapter
   16  for 3 years after the date of the violation. A person who
   17  commits a subsequent offense of such taking or possession is
   18  permanently ineligible for issuance of any license or permit
   19  under this chapter. A person who possesses for sale or sells a
   20  bear taken in violation of this section or rules of the
   21  commission commits a Level Four violation under s. 379.401.
   22         Section 2. This act shall take effect July 1, 2020.
