       Senator Lee moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 119 - 209
    4  and insert:
    5         Section 3. Section 339.287, Florida Statutes, is created to
    6  read:
    7         339.287 Electric vehicle charging stations; infrastructure
    8  plan development.—
    9         (1) The Legislature finds that:
   10         (a) Climate change may have significant impacts to this
   11  state which will require the development of avoidance,
   12  adaptation, and mitigation strategies to address these potential
   13  impacts on future state projects, plans, and programs;
   14         (b) A significant portion of the carbon dioxide emissions
   15  in this state are produced by the transportation sector;
   16         (c) Electric vehicles can help reduce these emissions,
   17  thereby helping to reduce the impact of climate change on this
   18  state;
   19         (d) The use of electric vehicles for non-local driving
   20  requires adequate, reliable charging stations to address
   21  electric vehicle battery range limitations;
   22         (e) Having adequate, reliable charging stations along the
   23  State Highway System will also help with evacuations during
   24  hurricanes or other disasters;
   25         (f) Ensuring the prompt installation of adequate, reliable
   26  charging stations is in the public interest; and
   27         (g) A recommended plan for electric vehicle charging
   28  station infrastructure should be established to address changes
   29  in the emerging electric vehicle market and necessary charging
   30  infrastructure.
   31         (2)(a) The department shall coordinate, develop, and
   32  recommend a master plan for current and future plans for the
   33  development of electric vehicle charging station infrastructure
   34  along the State Highway System, as defined in s. 334.03(24). The
   35  department shall develop the recommended master plan and submit
   36  it to the Governor, the President of the Senate, and the Speaker
   37  of the House of Representatives by July 1, 2021. The plan must
   38  include recommendations for legislation and may include other
   39  recommendations as determined by the department.
   40         (b) The department, in consultation with the Public Service
   41  Commission and the Office of Energy within the Department of
   42  Agriculture and Consumer Services, and any other public or
   43  private entities as necessary or appropriate, shall be primarily
   44  responsible for the following goals and objectives in developing
   45  the plan:
   46         1. Identifying the types or characteristics of possible
   47  locations for electric vehicle charging station infrastructure
   48  along the State Highway System to support a supply of electric
   49  vehicle charging stations that will:
   50         a. Accomplish the goals and objectives of this section;
   51         b. Support both short-range and long-range electric vehicle
   52  travel;
   53         c. Encourage the expansion of electric vehicle use in this
   54  state; and
   55         d. Adequately serve evacuation routes in this state.
   56         2. Identifying any barriers to the use of electric vehicles
   57  and electric vehicle charging station infrastructure both for
   58  short-range and long-range electric vehicle travel along the
   59  State Highway System.
   60         3. Identifying an implementation strategy for expanding
   61  electric vehicle and charging station infrastructure use in this
   62  state.
   63         4. Quantifying the loss of revenue to the State
   64  Transportation Trust Fund due to the current and projected
   65  future use of electric vehicles in this state and summarizing
   66  efforts of other states to address such revenue loss.
   67         (c) The Public Service Commission, in consultation with the
   68  department and the Office of Energy within the Department of
   69  Agriculture and Consumer Service, and any other public or
   70  private entities as necessary or appropriate, shall be primarily
   71  responsible for the following goals and objectives in developing
   72  the plan:
   73         1.Projecting the increase in the use of electric vehicles
   74  in this state over the next 20 years and determining how to
   75  ensure an adequate supply of reliable electric vehicle charging
   76  stations to support and encourage this growth in a manner
   77  supporting a competitive market with ample consumer choice.
   78         2.Evaluating and comparing the types of electric vehicle
   79  charging stations available at present and which may become
   80  available in the future, including the technology and
   81  infrastructure incorporated in such stations, along with the
   82  circumstances within which each type of station and
   83  infrastructure is typically used, including fleet charging, for
   84  the purpose of identifying any advantages to developing
   85  particular types or uses of these stations.
   86         3.Considering strategies to develop this supply of
   87  charging stations, including, but not limited to, methods of
   88  building partnerships with local governments, other state and
   89  federal entities, electric utilities, the business community,
   90  and the public in support of electric vehicle charging stations.
   91         4. Identifying the type of regulatory structure necessary
   92  for the delivery of electricity to electric vehicles and
   93  charging station infrastructure, including competitive neutral
   94  policies and the participation of public utilities in the
   95  marketplace.
   96         (d)The Public Service Commission, in consultation with the
   97  Office of Energy within the Department of Agriculture and
   98  Consumer Services, shall review emerging technologies in the
   99  electric and alternative vehicle market, including alternative
  100  fuel sources.
  101         (e) The department, the Public Service Commission, and the
  102  Office of Energy within the Department of Agriculture and
  103  Consumer Services may agree to explore other issues deemed
  104  necessary or appropriate for purposes of the report required in
  105  paragraph (a).
  106         (f) By December 1, 2020, the department shall file a status
  107  report with the Governor, the President of the Senate, and the
  108  Speaker of the House of Representatives containing any
  109  preliminary recommendations, including recommendations for
  110  legislation.

  126         the goals and objectives of the plan; requiring the
  127         commission, in consultation with specified entities,
  128         to review certain emerging technologies; authorizing
  129         the department, commission, and the Office of Energy
  130         within the Department of Agriculture and Consumer
  131         Services to explore other issues as necessary and
  132         appropriate; requiring the department to file a status
