       Senator Gibson moved the following:
       
    1         Senate Amendment to Substitute Amendment (271678) (with
    2  title amendment)
    3  
    4         Between lines 1605 and 1606
    5  insert:
    6         Section 34. Paragraph (c) is added to subsection (7) of
    7  section 1012.34, Florida Statutes, to read:
    8         1012.34 Personnel evaluation procedures and criteria.—
    9         (7) MEASUREMENT OF STUDENT PERFORMANCE.—
   10         (c) The Legislature intends that the public interest be
   11  protected by preventing the financial enrichment of owners,
   12  operators, managers, and other affiliated parties of charter
   13  schools receiving capital outlay funding. Therefore, a charter
   14  school additionally is not eligible for a funding allocation
   15  unless the chair of the governing board and the chief
   16  administrative officer of the charter school annually certify
   17  under oath that the funds will be used solely and exclusively
   18  for constructing, renovating, or improving charter school
   19  facilities that are owned by a school district, a political
   20  subdivision of the state, a municipality, a Florida College
   21  System institution, or a state university.

   24  And the title is amended as follows:
   25         Between lines 1964 and 1965
   26  insert:
   27         1012.34, F.S.; providing legislative intent; providing
   28         that a charter school is not eligible for a capital
   29         outlay funding allocation unless certain officials of
   30         the charter school annually certify under oath that
   31         funds will be used in a specified manner; amending s.
