Florida Senate - 2020 CS for SB 724 By the Committee on Environment and Natural Resources; and Senator Albritton 592-02007A-20 2020724c1 1 A bill to be entitled 2 An act relating to local government recycling 3 programs; amending s. 403.706, F.S.; creating the 4 Florida Recycling Working Group; providing the duties 5 and membership of the working group; requiring the 6 working group to submit a report to the Legislature by 7 a specified date; providing an expiration date for the 8 working group; providing an exemption for fiscally 9 constrained counties from recycling requirements; 10 providing an expiration date for the exemption; 11 providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Subsections (23) and (24) are added to s. 16 403.706, Florida Statutes, to read: 17 403.706 Local government solid waste responsibilities.— 18 (23)(a) The Florida Recycling Working Group is created 19 within the department and shall be composed of eleven members, 20 with each of the following eleven organizations appointing one 21 representative member from within their respective 22 organizations: 23 1. The department. 24 2. The University of Florida’s Engineering School of 25 Sustainable Infrastructure and Environment. 26 3. The Hinkley Center for Solid and Hazardous Waste 27 Management. 28 4. The Florida League of Cities. 29 5. The Florida Association of Counties. 30 6. The Florida Recycling Partnership. 31 7. Keep Florida Beautiful. 32 8. The Florida Beverage Association. 33 9. Southern Waste Information eXchange, Inc. 34 10. The Florida Chapter of the National Waste and Recycling 35 Association. 36 11. Recycle Florida Today, Inc. 37 (b) The working group shall meet at least three times and 38 elect, by quorum, a chair and a vice chair. A quorum shall 39 consist of a majority of the members. The chair of the working 40 group shall preside at all meetings and shall call a meeting as 41 often as necessary to carry out this subsection. The department 42 shall keep a complete record of the proceedings of each meeting, 43 including the names of the members present at each meeting and 44 the actions taken. The records are public records pursuant to 45 chapter 119. 46 (c) The working group shall compile a report recommending 47 programs and statutory changes necessary for achieving future 48 recycling goals based on current progress toward achieving the 49 goals set in subsection (2). The working group shall submit the 50 report to the President of the Senate and the Speaker of the 51 House of Representatives by July 1, 2021. 52 (d) This subsection expires July 1, 2021. 53 (24) A fiscally constrained county, as defined in s. 54 218.67(1), is exempt from the goals and requirements set forth 55 in this section. This subsection expires July 1, 2035. 56 Section 2. This act shall take effect July 1, 2020.
