    1                        A bill to be entitled                      
    2         An act relating to the property assessed clean energy
    3         program; amending s. 163.08, F.S.; amending the
    4         definition of “qualifying improvement” to include
    5         sewage treatment, seawall improvements, and certain
    6         improvements to underground infrastructure; providing
    7         an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (b) of subsection (2) of section
   12  163.08, Florida Statutes, is amended to read:
   13         163.08 Supplemental authority for improvements to real
   14  property.—
   15         (2) As used in this section, the term:
   16         (b) “Qualifying improvement” includes any:
   17         1. Energy conservation and efficiency improvement, which is
   18  a measure to reduce consumption through conservation or a more
   19  efficient use of electricity, natural gas, propane, or other
   20  forms of energy on the property, including, but not limited to,
   21  air sealing; installation of insulation; installation of energy
   22  efficient heating, cooling, or ventilation systems; building
   23  modifications to increase the use of daylight; replacement of
   24  windows; installation of energy controls or energy recovery
   25  systems; installation of electric vehicle charging equipment;
   26  and installation of efficient lighting equipment.
   27         2. Renewable energy improvement, which is the installation
   28  of any system in which the electrical, mechanical, or thermal
   29  energy is produced from a method that uses one or more of the
   30  following fuels or energy sources: hydrogen, solar energy,
   31  geothermal energy, bioenergy, and wind energy.
   32         3. Wind resistance improvement, which includes, but is not
   33  limited to:
   34         a. Improving the strength of the roof deck attachment;
   35         b. Creating a secondary water barrier to prevent water
   36  intrusion;
   37         c. Installing wind-resistant shingles;
   38         d. Installing gable-end bracing;
   39         e. Reinforcing roof-to-wall connections;
   40         f. Installing storm shutters; or
   41         g. Installing opening protections.
   42         4.Sewage treatment improvement, which includes the
   43  replacement of an onsite sewage treatment and disposal system
   44  with an advanced onsite sewage treatment system and the
   45  replacement of an onsite sewage treatment and disposal system
   46  with a central sewage system.
   47         5.Seawall improvement, which includes seawall repairs and
   48  seawall replacements.
   49         6. Raising of electrical boxes, raising of home
   50  foundations, and other improvements to the underground
   51  infrastructure of homes to promote greater resiliency.
   52         Section 2. This act shall take effect July 1, 2020.
