       The Committee on Judiciary (Rodriguez) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 17 - 21
    4  and insert:
    5  claim arising under a property insurance policy, the court shall
    6  determine a reasonable fee under the lodestar method. However, a
    7  contingency fee multiplier shall be applied in rare or
    8  exceptional circumstances in consideration of the following
    9  factors:
   10         (a) Whether the relevant market requires a contingency fee
   11  multiplier to obtain competent counsel;
   12         (b) Whether the attorney was able to mitigate the risk of
   13  nonpayment in any way; and
   14         (c) Whether the amount involved and the results obtained
   15  justify a contingency fee multiplier.
