       Senator Jones moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 306 and 307
    4  insert:
    5         (c)The State of Florida has a duty to equitably and fairly
    6  enforce its laws, with little to no disparate impact on the
    7  members of any specific racial or ethnic group. If the State of
    8  Florida or a person authorized by the State of Florida breaches
    9  that duty, the state is civilly liable for any damages
   10  proximately caused by the breach of duty by the state or the
   11  authorized person. This liability is limited to any adverse
   12  impact stemming from the disproportionate application of various
   13  laws adopted to combat public disorder. The sovereign immunity
   14  recovery limits in paragraph (a) do not apply to an action under
   15  this paragraph.
