Florida Senate - 2021 SB 1038 By Senator Berman 31-00075A-21 20211038__ 1 A bill to be entitled 2 An act relating to insurance coverage for breast 3 cancer tests and procedures; creating ss. 627.42394 4 and 641.3133, F.S.; defining terms; prohibiting 5 certain health insurance policies and health 6 maintenance contracts from applying cost-sharing 7 requirements to certain breast cancer tests and 8 procedures; authorizing the Financial Services 9 Commission to adopt rules; providing an effective 10 date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 627.42394, Florida Statutes, is created 15 to read: 16 627.42394 Coverage for diagnostic mammograms, breast 17 magnetic resonance imaging scans, and breast ultrasounds.— 18 (1) As used in this section, the term: 19 (a) “Cost sharing” has the same meaning as in s. 627.42391. 20 (b) “Health care provider” means a physician licensed under 21 chapter 458 or chapter 459, a physician assistant licensed under 22 chapter 458 or chapter 459, or an advanced practice registered 23 nurse licensed under chapter 464. 24 (2) An individual or group, blanket, or franchise health 25 insurance policy delivered, issued for delivery, renewed, 26 amended, or continued in this state which provides coverage for 27 diagnostic mammograms, breast magnetic resonance imaging scans, 28 or breast ultrasounds may not apply cost-sharing requirements 29 for a diagnostic mammogram, breast magnetic resonance imaging 30 scan, or breast ultrasound, respectively, which is ordered by an 31 insured’s health care provider. 32 (3) The commission may adopt rules to administer this 33 section. 34 Section 2. Section 641.3133, Florida Statutes, is created 35 to read: 36 641.3133 Coverage for diagnostic mammograms, breast 37 magnetic resonance imaging scans, and breast ultrasounds.— 38 (1) As used in this section, the term: 39 (a) “Cost sharing” has the same meaning as in s. 641.313. 40 (b) “Health care provider” means a physician licensed under 41 chapter 458 or chapter 459, a physician assistant licensed under 42 chapter 458 or chapter 459, or an advanced practice registered 43 nurse licensed under chapter 464. 44 (2) A health maintenance contract delivered, issued for 45 delivery, renewed, amended, or continued in this state which 46 provides coverage for diagnostic mammograms, breast magnetic 47 resonance imaging scans, or breast ultrasounds may not apply 48 cost-sharing requirements for a diagnostic mammogram, breast 49 magnetic resonance imaging scan, or breast ultrasound, 50 respectively, which is ordered by a subscriber’s health care 51 provider. 52 (3) The commission may adopt rules to administer this 53 section. 54 Section 3. This act shall take effect January 1, 2022.
