       The Committee on Commerce and Tourism (Bean) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 50 - 66
    4  and insert:
    5         (5) This section does not apply to any person or entity
    6  that publishes or disseminates information relating to arrest
    7  booking photographs unless:
    8         (a) The person or entity solicits or accepts payment to
    9  remove the photographs; or
   10         (b) The person or entity’s primary business model is the
   11  publishing and disseminating of arrest booking photographs for a
   12  commercial purpose or pecuniary gain.
