       The Committee on Rules (Brodeur) recommended the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 83 and 84
    4  insert:
    5         Section 3. Paragraph (e) is added to subsection (1) of
    6  section 403.928, Florida Statutes, to read:
    7         403.928 Assessment of water resources and conservation
    8  lands.—The Office of Economic and Demographic Research shall
    9  conduct an annual assessment of Florida’s water resources and
   10  conservation lands.
   11         (1) WATER RESOURCES.—The assessment must include all of the
   12  following:
   13         (e)Beginning with the assessment due January 1, 2022, an
   14  analysis of the expenditures necessary to repair, replace, and
   15  expand water-related infrastructure. As part of this analysis,
   16  the office shall periodically survey public and private
   17  utilities.
   18         Section 4. Section 403.9301, Florida Statutes, is created
   19  to read:
   20         403.9301Wastewater services projections.—
   21         (1)The Legislature intends for each county, municipality,
   22  or special district providing wastewater services to create a
   23  20-year needs analysis.
   24         (2)As used in this section, the term:
   25         (a)“Domestic wastewater” has the same meaning as provided
   26  in s. 367.021.
   27         (b)“Facility” means any equipment, structure, or other
   28  property, including sewerage systems and treatment works, used
   29  to provide wastewater services.
   30         (c)“Treatment works” has the same meaning as provided in
   31  s. 403.031(11).
   32         (d)“Wastewater services” means service to a sewerage
   33  system, as defined in s. 403.031(9), or service to domestic
   34  wastewater treatment works.
   35         (3)By June 30, 2022, and every 5 years thereafter, each
   36  county, municipality, or special district providing wastewater
   37  services shall develop a needs analysis for its jurisdiction
   38  over the subsequent 20 years. In projecting such needs, each
   39  local government shall include the following:
   40         (a)A detailed description of the facilities used to
   41  provide wastewater services.
   42         (b)The number of current and projected connections and
   43  residents served, calculated in 5-year increments.
   44         (c)The current and projected service area for wastewater
   45  services.
   46         (d)The current and projected cost of providing wastewater
   47  services, calculated in 5-year increments.
   48         (e)The estimated remaining useful life of each facility or
   49  its major components.
   50         (f)The most recent 5-year history of annual contributions
   51  to, expenditures from, and balances of any capital account for
   52  maintenance or expansion of any facility or its major
   53  components.
   54         (g)The local government’s plan to fund the maintenance or
   55  expansion of any facility or its major components. The plan must
   56  include historical and estimated future revenues and
   57  expenditures with an evaluation of how the local government
   58  expects to close any projected funding gap.
   59         (4)Upon completing the requirements of subsection (3),
   60  each municipality or special district shall submit its needs
   61  analysis, as well as the methodology and any supporting data
   62  necessary to interpret the results, to the county within which
   63  the largest portion of its service area is located. Each county
   64  shall compile all analyses submitted to it under this subsection
   65  into a single document and include its own analysis in the
   66  document. The county shall file the compiled document with the
   67  coordinator of the Office of Economic and Demographic Research
   68  no later than July 31, 2022, and every 5 years thereafter.
   69         (5)The Office of Economic and Demographic Research shall
   70  evaluate the compiled documents from the counties for the
   71  purpose of developing a statewide analysis for inclusion in the
   72  assessment due January 1, 2023, pursuant to s. 403.928.
   73         Section 5. Section 403.9302, Florida Statutes, is created
   74  to read:
   75         403.9302Stormwater management projections.—
   76         (1)The Legislature intends for each county, municipality,
   77  or special district providing a stormwater management program or
   78  stormwater management system to create a 20-year needs analysis.
   79         (2)As used in this section, the term:
   80         (a)“Facility” means any equipment, structure, or other
   81  property, including conveyance systems, used or useful in
   82  connection with providing a stormwater management program or
   83  stormwater management system.
   84         (b)“Stormwater management program” has the same meaning as
   85  provided in s. 403.031(15).
   86         (c)“Stormwater management system” has the same meaning as
   87  provided in s. 403.031(16).
   88         (3)By June 30, 2022, and every 5 years thereafter, each
   89  county, municipality, or special district providing a stormwater
   90  management program or stormwater management system shall develop
   91  a needs analysis for its jurisdiction over the subsequent 20
   92  years. In projecting such needs, each local government shall
   93  include the following:

   95  program or stormwater management system and its facilities and
   96  projects.

  124  Economic and Demographic Research no later than July 31, 2022,
  125  and every 5 years thereafter.
  126         (5)The Office of Economic and Demographic Research shall
  127  evaluate the compiled documents from the counties for the
  128  purpose of developing a statewide analysis for inclusion in the
  129  assessment due January 1, 2023, pursuant to s. 403.928.
  130         Section 6. The Legislature determines and declares that
  131  this act fulfills an important state interest.

  145         a specified date; requiring municipalities and special
  146         districts to submit such analyses to a specified
  147         county; requiring the county to file a compiled
  148         document with the coordinator of the Office of
  149         Economic and Demographic Research by a specified date
  150         and periodically thereafter; requiring the office to
  151         evaluate the document and include an analysis in its
  152         annual assessment; creating s. 403.9302, F.S.;
  153         providing legislative intent; defining terms;
  154         requiring counties, municipalities, and special
  155         districts that provide stormwater management to
  156         develop a needs analysis that includes certain
  157         information by a specified date; requiring
  158         municipalities and special districts to submit such
  159         analyses to a specified county; requiring the county
  160         to file a compiled document with the Secretary of
  161         Environmental Protection and the coordinator of the
  162         Office of Economic and Demographic Research by a
  163         specified date and periodically thereafter; requiring
  164         the office to evaluate the document and include an
  165         analysis in its annual assessment; providing a
  166         determination and declaration of important state
  167         interest; providing an effective date.
