       The Committee on Rules (Rodrigues) recommended the following:
       
    1         Senate Amendment

    3         Delete lines 69 - 75
    4  and insert:
    5         (6) This section does not apply to:
    6         (a) A DNA sample, a DNA analysis, or the results of a DNA
    7  analysis used for the purposes of:
    8         1. Criminal investigation or prosecution;
    9         2. Determining paternity under s. 409.256 or s. 742.12(1);
   10  or
   11         3. Performing any activity authorized under s. 943.325.
   12         (b) Information de-identified in accordance with 45 C.F.R.
   13  part 164 and derived from individually identifiable health
   14  information as described in the Health Insurance Portability and
   15  Accountability Act of 1996, or identifiable personal
   16  information, consistent with the Federal Policy for the
   17  Protection of Human Subjects or the human subject protection
   18  requirements of the United States Food and Drug Administration.
