Senator Brandes moved the following:

4 and insert:
5 Section 22. Effective July 1, 2022, part IV of chapter 343,
6 Florida Statutes, consisting of ss. 343.90, 343.91, 343.92,
7 343.922, 343.94, 343.941, 343.943, 343.944, 343.947, 343.95,
8 343.96, 343.962, 343.97, 343.973, 343.975, and 343.976, Florida
9 Statutes, is repealed.
10 Section 23. Effective July 1, 2022, notwithstanding any
11 other law, the Tampa Bay Area Regional Transit Authority is
12 dissolved. The authority shall discharge or make provision for
13 the authority’s debts, obligations, and other liabilities;
14 settle and close the authority’s activities and affairs; and
15 provide for distribution of the authority’s assets, or the
16 proceeds of such assets, such that each local general-purpose
17 government represented on the authority’s board receives a
18 distribution generally in proportion to each entity’s
19 contribution to the acquisition of the assets.
20 Section 24. Effective July 1, 2022, paragraph (i) of
21 subsection (6) of section 339.175, Florida Statutes, is amended
22 to read:
23 339.175 Metropolitan planning organization.—
24 (6) POWERS, DUTIES, AND RESPONSIBILITIES.—The powers,
25 privileges, and authority of an M.P.O. are those specified in
26 this section or incorporated in an interlocal agreement
27 authorized under s. 163.01. Each M.P.O. shall perform all acts
28 required by federal or state laws or rules, now and subsequently
29 applicable, which are necessary to qualify for federal aid. It
30 is the intent of this section that each M.P.O. shall be involved
31 in the planning and programming of transportation facilities,
32 including, but not limited to, airports, intercity and high
33 speed rail lines, seaports, and intermodal facilities, to the
34 extent permitted by state or federal law.
35 (i) The Tampa Bay Area Regional Transit Authority
36 Metropolitan Planning Organization Chairs Coordinating Committee
37 is created within the Tampa Bay Area Regional Transit Authority,
38 composed of the M.P.O.’s serving Citrus, Hernando, Hillsborough,
39 Manatee, Pasco, Pinellas, Polk, and Sarasota Counties. The
40 authority shall provide administrative support and direction to
41 the committee. The committee must, at a minimum:
42 1. Coordinate transportation projects deemed to be
43 regionally significant by the committee.
44 2. Review the impact of regionally significant land use
45 decisions on the region.
46 3. Review all proposed regionally significant
47 transportation projects in the respective transportation
48 improvement programs which affect more than one of the M.P.O.’s
49 represented on the committee.
50 4. Institute a conflict resolution process to address any
51 conflict that may arise in the planning and programming of such
52 regionally significant projects.
53 Section 25. Effective July 1, 2022, paragraph (b) of
54 subsection (3) of section 341.302, Florida Statutes, is amended
55 to read:
56 341.302 Rail program; duties and responsibilities of the
57 department.—The department, in conjunction with other
58 governmental entities, including the rail enterprise and the
59 private sector, shall develop and implement a rail program of
60 statewide application designed to ensure the proper maintenance,
61 safety, revitalization, and expansion of the rail system to
62 assure its continued and increased availability to respond to
63 statewide mobility needs. Within the resources provided pursuant
64 to chapter 216, and as authorized under federal law, the
65 department shall:
66 (3) Develop and periodically update the rail system plan,
67 on the basis of an analysis of statewide transportation needs.
68 (b) In recognition of the department’s role in the
69 enhancement of the state’s rail system to improve freight and
70 passenger mobility, the department shall:
71 1. Work closely with all affected communities along an
72 impacted freight rail corridor to identify and address
73 anticipated impacts associated with an increase in freight rail
74 traffic due to implementation of passenger rail.
75 2. In coordination with the affected local governments and
76 CSX Transportation, Inc., finalize all viable alternatives from
77 the department’s Rail Traffic Evaluation Study to identify and
78 develop an alternative route for through freight rail traffic
79 moving through Central Florida, including the counties of Polk
80 and Hillsborough, which would address, to the extent
81 practicable, the effects of commuter rail.
82 3. Provide technical assistance to a coalition of local
83 governments in Central Florida, including the counties of
84 Brevard, Citrus, Hernando, Hillsborough, Lake, Marion, Orange,
85 Osceola, Pasco, Pinellas, Polk, Manatee, Sarasota, Seminole,
86 Sumter, and Volusia, and the municipalities within those
87 counties, to develop a regional rail system plan that addresses
88 passenger and freight opportunities in the region, is consistent
89 with the Florida Rail System Plan, and incorporates appropriate
90 elements of the Tampa Bay Area Regional Authority Master Plan,
91 the Metroplan Orlando Regional Transit System Concept Plan,
92 including the SunRail project, and the Florida Department of
93 Transportation Alternate Rail Traffic Evaluation.
94 Section 26. Except as otherwise expressly provided in this
95 act, this act shall take effect July 1, 2021.

102 to the creation and operation of the Tampa Bay Area

106 affairs, and provide for the distribution of the
107 authority’s assets; amending ss. 339.175 and 341.302,
108 F.S.; conforming provisions to changes made by the
109 act; providing effective dates.
