Subsection (14) is added to section 316.302, 6 Florida Statutes, to read: 7 316.302 Commercial motor vehicles; safety regulations; 8 transporters and shippers of hazardous materials; enforcement.— 9 (14)(a) The deployment, implementation, or use of a motor 10 carrier safety improvement by or as required by a motor carrier 11 or its related entity or a third party, including by contract, 12 may not be considered when evaluating an individual’s status as 13 an employee or independent contractor or as a jointly employed 14 employee under any state law. 15 (b) For purposes of this subsection, the term “motor 16 carrier safety improvement” means any device, equipment, 17 software, technology, procedure, training, policy, program, or 18 operational practice intended and primarily used to improve or 19 facilitate: 20 1. Compliance with traffic safety or motor carrier safety 21 laws; 22 2. Safety of a motor vehicle; 23 3. Safety of the operator of a motor vehicle; or 24 4.
