    2         An act relating to Divine Nine specialty license
    3         plates; amending s. 320.08058, F.S.; revising
    4         distribution of annual use fees from the sale of the
    5         plates; providing eligibility requirements for
    6         issuance of a plate; authorizing a plate to be
    7         personalized and to be displayed on certain vehicles;
    8         prohibiting the transfer of a plate between vehicle
    9         owners; providing an effective date.
   10          
   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (101) of section 320.08058, Florida
   14  Statutes, is amended to read:
   15         320.08058 Specialty license plates.—
   16         (101) DIVINE NINE LICENSE PLATES.—
   17         (a) The department shall develop a Divine Nine license
   18  plate as provided in this section and s. 320.08053 using a
   19  standard template and a unique logo, graphic, or color for each
   20  of the organizations listed in sub-subparagraphs (b)3.a.-i.
   21  (b)2.a.-i. The plate must bear the colors and design approved by
   22  the department, and must include the official logo, graphic, or
   23  color as appropriate for each organization. The word “Florida”
   24  must appear at the top of the plate, and the words “Divine Nine”
   25  must appear at the bottom of the plate.
   26         (b) The annual use fees from the sale of the plate shall be
   27  distributed as follows:
   28         1. Five percent of the proceeds shall be distributed to the
   29  United Negro College Fund, Inc., for college scholarships for
   30  Florida residents attending Florida’s historically black
   31  colleges and universities.
   32         2.Ten percent of the proceeds shall be distributed to the
   33  Association to Preserve African-American Society, History, and
   34  Tradition (PAST), Inc., solely for the marketing of the plate.
   35         3.2. The remaining 85 95 percent of the proceeds shall be
   36  distributed to one of the following organizations as selected by
   37  the purchaser of the plate who, upon fulfilling the requirements
   38  of paragraph (c), shall receive a license plate with the logo,
   39  graphic, or color associated with the appropriate recipient
   40  organization:
   41         a. Alpha Phi Alpha Fraternity, Inc.
   42         (I) Eighty-five percent shall be distributed to the Florida
   43  Federation of Alpha Chapters, Inc., to promote community
   44  awareness and action through educational, economic, and cultural
   45  service activities within this state.
   46         (II)Ten percent shall be distributed to the Florida
   47  Federation of Alpha Chapters, Inc., solely for the marketing of
   48  the plate.
   49         b. Alpha Kappa Alpha Sorority, Inc.
   50         (I) Eighty-five percent shall be distributed to the Alpha
   51  Kappa Alpha Educational Advancement Foundation, Inc., to promote
   52  community awareness and action through educational, economic,
   53  and cultural service activities within this state.
   54         (II)Ten percent shall be distributed to the Alpha Kappa
   55  Alpha Educational Advancement Foundation, Inc., solely for the
   56  marketing of the plate.
   57         c. Kappa Alpha Psi Fraternity, Inc.
   58         (I) Eighty-five percent shall be distributed to the
   59  Southern Province of Kappa Alpha Psi Fraternity, Inc., to
   60  promote community awareness and action through educational,
   61  economic, and cultural service activities within this state.
   62         (II)Ten percent shall be distributed to the Southern
   63  Province of Kappa Alpha Psi Fraternity, Inc., solely for the
   64  marketing of the plate.
   65         d. Omega Psi Phi Fraternity, Inc.
   66         (I) Eighty-five percent shall be distributed to the State
   67  of Florida Omega Friendship Foundation, Inc., to promote
   68  community awareness and action through educational, economic,
   69  and cultural service activities within this state.
   70         (II)Ten percent shall be distributed to the State of
   71  Florida Omega Friendship Foundation, Inc., solely for the
   72  marketing of the plate.
   73         e. Delta Sigma Theta Sorority, Inc.
   74         (I) Eighty-five percent shall be distributed to the Delta
   75  Research and Educational Foundation, Inc., to promote community
   76  awareness and action through educational, economic, and cultural
   77  service activities within this state.
   78         (II)Ten percent shall be distributed to the Delta Research
   79  and Educational Foundation, Inc., solely for the marketing of
   80  the plate.
   81         f. Phi Beta Sigma Fraternity, Inc.
   82         (I) Eighty-five percent shall be distributed to the TMB
   83  Charitable Foundation, Inc., to promote community awareness and
   84  action through educational, economic, and cultural service
   85  activities within this state.
   86         (II)Ten percent shall be distributed to the TMB Charitable
   87  Foundation, Inc., solely for the marketing of the plate.
   88         g. Zeta Phi Beta Sorority, Inc.
   89         (I) Eighty-five percent shall be distributed to the Florida
   90  Pearls, Inc., to promote community awareness and action through
   91  educational, economic, and cultural service activities within
   92  this state.
   93         (II)Ten percent shall be distributed to the Florida
   94  Pearls, Inc., solely for the marketing of the plate.
   95         h. Sigma Gamma Rho Sorority, Inc.
   96         (I) Eighty-five percent shall be distributed to the Sigma
   97  Gamma Rho Sorority National Education Fund, Inc., to promote
   98  community awareness and action through educational, economic,
   99  and cultural service activities within this state.
  100         (II)Ten percent shall be distributed to the Sigma Gamma
  101  Rho Sorority National Education Fund, Inc., solely for the
  102  marketing of the plate.
  103         i. Iota Phi Theta Fraternity, Inc.
  104         (I) Eighty-five percent shall be distributed to the
  105  National Iota Foundation, Inc., to promote community awareness
  106  and action through educational, economic, and cultural service
  107  activities within this state.
  108         (II)Ten percent shall be distributed to the National Iota
  109  Foundation, Inc., solely for the marketing of the plate.
  110         (c)1.To be eligible for issuance of a Divine Nine license
  111  plate representing an organization listed in sub-subparagraphs
  112  (b)3.a.-i., a person must be a resident of this state who is the
  113  registered owner of a motor vehicle and who is a member of the
  114  applicable organization. The person must also present proof of
  115  membership in the organization, which may be established by:
  116         a.A card distributed by the organization indicating the
  117  person’s membership in the organization; or
  118         b.A written letter on the organization’s letterhead which
  119  is signed by the organization’s national president or his or her
  120  designated official and which states that the person was
  121  inducted into the organization.
  122         2.Proof of membership in an organization listed in sub
  123  subparagraphs (b)3.a.-i. is required only for initial issuance
  124  of a Divine Nine license plate. A person need not present such
  125  proof for renewal of the license plate.
  126         (d)A Divine Nine license plate:
  127         1.May be personalized.
  128         2.Notwithstanding any other law to the contrary, may be
  129  displayed on a privately owned passenger motor vehicle, pickup
  130  truck, motorcycle, boat, or pleasure motor vehicle including,
  131  but not limited to, a recreational vehicle.
  132         3.May not be transferred between vehicle owners.

  134  License plates created pursuant to this subsection shall have
  135  their plate sales combined for the purpose of meeting the
  136  minimum license plate sales threshold in s. 320.08056(8)(a) and
  137  for determining the license plate limit in s. 320.08053(3)(b).
  138  License plates created pursuant to this subsection must be
  139  ordered directly from the department.
  140         Section 2. This act shall take effect October 1, 2021.
