Florida Senate - 2021 SB 1202 By Senator Polsky 29-01096-21 20211202__ 1 A bill to be entitled 2 An act relating to fee waivers; amending s. 1009.26, 3 F.S.; authorizing each Florida College System 4 institution, career center operated by a school 5 district, and charter technical career center to waive 6 out-of-state fees for students living in a recovery 7 residence; prohibiting tuition and fees charged to a 8 student who is granted the waiver from exceeding the 9 tuition and fees charged to a resident student; 10 providing that the waiver is applicable for 110 11 percent of the required credit hours of the degree or 12 certificate program for which the student is enrolled; 13 requiring each Florida College System institution, 14 career center operated by a school district, and 15 charter technical career center to report to the State 16 Board of Education the number and value of all such 17 waivers granted annually; requiring the State Board of 18 Education to adopt rules; providing an effective date. 19 20 Be It Enacted by the Legislature of the State of Florida: 21 22 Section 1. Subsection (18) is added to section 1009.26, 23 Florida Statutes, to read: 24 1009.26 Fee waivers.— 25 (18)(a) Each Florida College System institution, career 26 center operated by a school district under s. 1001.44, and 27 charter technical career center under s. 1002.34 may waive out 28 of-state fees for students living in a recovery residence as 29 defined in s. 397.311. 30 (b) Tuition and fees charged to a student who is granted an 31 out-of-state fee waiver under this subsection may not exceed the 32 tuition and fees charged to a resident student. The waiver is 33 applicable for 110 percent of the required credit hours of the 34 degree or certificate program for which the student is enrolled. 35 (c) Each Florida College System institution, career center 36 operated by a school district under s. 1001.44, and charter 37 technical career center under s. 1002.34 shall report to the 38 State Board of Education the number and value of all fee waivers 39 granted annually under this subsection. 40 (d) The State Board of Education shall adopt rules to 41 administer this subsection. 42 Section 2. This act shall take effect July 1, 2021.
