    1                        A bill to be entitled                      
    2         An act relating to records retention for emergency
    3         communications; amending s. 365.171, F.S.; requiring
    4         the statewide emergency communications E911 system
    5         plan developed by the Division of Telecommunications
    6         within the Department of Management Services to
    7         include a provision requiring the retention by the
    8         public agency of electronic and written emergency
    9         communications for a specified period; providing an
   10         effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Paragraph (e) is added to subsection (4) of
   15  section 365.171, Florida Statutes, to read:
   16         365.171 Emergency communications number E911 state plan.—
   17         (4) STATE PLAN.—The office shall develop, maintain, and
   18  implement appropriate modifications for a statewide emergency
   19  communications E911 system plan. The plan shall provide for:
   20         (e) Retention by the public agency of all recorded
   21  electronic and written emergency communications for 2 years, or
   22  longer if required by an order entered by a court of competent
   23  jurisdiction or a valid subpoena.

   25  The office shall be responsible for the implementation and
   26  coordination of such plan. The office shall adopt any necessary
   27  rules and schedules related to public agencies for implementing
   28  and coordinating the plan, pursuant to chapter 120.
   29         Section 2. This act shall take effect July 1, 2021.
