Paragraph (c) of subsection (2) of section 6 381.00655, Florida Statutes, is amended to read 7 381.00655 Connection of existing onsite sewage treatment 8 and disposal systems to central sewerage system; requirements.— 9 (2) The provisions of subsection (1) or any other provision 10 of law to the contrary notwithstanding: 11 (c) A local government or water and sewer district 12 responsible for the operation of a centralized sewer system 13 under s. 153.62 may grant a variance to an owner of a 14 performance-based onsite sewage treatment and disposal system 15 permitted by the department as long as the onsite system is 16 functioning properly and satisfying the conditions of the 17 operating permit. The department or a district created under 18 chapter 189 may waive the requirements for the owner of an 19 individual septic system to connect to a centralized sewer 20 system or construct an onsite treatment system provided the 21 individual lots operating on a septic system was identified in 22 the master plan of the centralized sewer plan and approved by 23 the permitting entities as being excluded for service by the 24 centralized sewer system.Nothing inThis paragraph may not 25shallbe construed to require a local government or water and 26 sewer district to issue a variance under any circumstance. 27Nothing inThis paragraph may notshallbe construed as limiting 28 local government authority to enact ordinances under s. 4, 29 chapter 99-395, Laws of Florida. A local government or water and 30 sewer district located in any of the following areas isshall31 notberequired to issue a variance under any circumstance: 32 1. An area of critical state concern. 33 2. An area that was designated as an area of critical state 34 concern for at least 20 consecutive years prior to removal of 35 the designation. 36 3. An area in the South Florida Water Management District 37 west C-11 basin that discharges through the S-9 pump into the 38 Everglades. 39 4.
