Section 817.418, Florida Statutes, is created to 25 read: 26 817.418 Offering for sale or advertising personal 27 protective equipment with intent to defraud.— 28 (1) As used in this section, the term “personal protective 29 equipment” means protective clothing or equipment, including, 30 but not limited to, face masks, face shields, gloves, goggles, 31 gowns, helmets, or respirators designed to protect a person from 32 infectious materials, communicable disease, or other illness. 33 (2) It is unlawful for any person to knowingly and 34 willfully make a materially false or misleading statement or to 35 knowingly and willfully disseminate false or misleading 36 information relating to the characteristics, authenticity, 37 effectiveness, or availability of personal protective equipment 38 in any marketing or advertising material; on a website, social 39 media platform, or other media; or by telephone, text message, 40 mail, or e-mail, with the intent to obtain or receive any money 41 or other valuable consideration. 42 (a) Except as provided in paragraph (b), a person who 43 violates this subsection commits a felony of the third degree, 44 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 45 (b) A person who commits a second or subsequent violation 46 of this subsection commits a felony of the second degree, 47 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 48 (3) Prosecution for a violation of this section may be 49 brought on behalf of the state by any state attorney or by the 50 statewide prosecutor. 51 (4) If the Attorney General reasonably believes that a 52 person has committed a violation of this section, the Attorney 53 General may institute a civil action for a violation of this 54 section or to prevent a violation of this section. An action for 55 relief may include a permanent or temporary injunction, a 56 restraining order, or any other appropriate order. 57 Section 2. Section 817.504, Florida Statutes, is created to 58 read: 59 817.504 Offering or advertising a vaccine with intent to 60 defraud.— 61 (1) It is unlawful for any person to knowingly and 62 willfully make a materially false or misleading statement or to 63 knowingly and willfully disseminate false or misleading 64 information regarding the availability of, or access to, a 65 vaccine for the novel coronavirus “COVID-19” or a vaccine for 66 any other pandemic disease in any marketing or advertising 67 material; on a website, social media platform, or other media; 68 or by telephone, text message, mail, or e-mail, with the intent 69 to obtain another person’s personal identification information, 70 as defined in s. 817.568(1)(f), or to obtain or receive any 71 money or other valuable consideration. 72 (a) Except as provided in paragraph (b), a person who 73 violates this subsection commits a felony of the third degree, 74 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 75 (b) A person who commits a second or subsequent violation 76 of this subsection commits a felony of the second degree, 77 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 78 (2) Prosecution for a violation of this section may be 79 brought on behalf of the state by any state attorney or by the 80 statewide prosecutor. 81 (3) If the Attorney General reasonably believes that a 82 person has committed a violation of this section, the Attorney 83 General may institute a civil action for a violation of this 84 section or to prevent a violation of this section.
