Florida Senate - 2021 SB 1666 By Senator Hutson 7-01463A-21 20211666__ 1 A bill to be entitled 2 An act relating to private investigative and security 3 services; amending s. 493.6111, F.S.; requiring the 4 Department of Agriculture and Consumer Services to 5 issue a Class “G” license to persons who meet 6 specified requirements; amending s. 493.6115, F.S.; 7 revising eligibility requirements for Class “C” and 8 Class “CC” licensees to carry firearms; providing an 9 effective date. 10 11 WHEREAS, all citizens, including licensed private 12 investigators, are entitled to self-defense and self-protection, 13 including the right to protections afforded under the Second 14 Amendment of the United States Constitution, and 15 WHEREAS, the Legislature finds that licensed private 16 investigators who hold a valid state license to carry concealed 17 firearms are entitled to carry a concealed firearm at any time 18 and at any location unless prohibited under this state’s laws, 19 and that licensed private investigators have the right to carry 20 a firearm during the course of their duties, NOW, THEREFORE, 21 22 Be It Enacted by the Legislature of the State of Florida: 23 24 Section 1. Subsection (7) is added to section 493.6111, 25 Florida Statutes, to read: 26 493.6111 License; contents; identification card.— 27 (7) The department shall issue a Class “G” license to any 28 Class “C” or Class “CC” licensee who has a license to carry 29 concealed firearms issued pursuant to s. 790.06. 30 Section 2. Subsections (2) and (4) of section 493.6115, 31 Florida Statutes, are amended to read: 32 493.6115 Weapons and firearms.— 33 (2)(a) Except as provided in paragraph (b), only Class “C,” 34 Class “CC,” Class “D,” Class “M,” Class “MA,” or Class “MB” 35 licensees are permitted to bear a firearm and any such licensee 36 who bears a firearm shall also have a Class “G” license. 37 (b)1. A Class “C” or Class “CC” licensee who does not have 38 a Class “G” license may carry a concealed firearm if the 39 licensee has a license to carry concealed firearms issued 40 pursuant to s. 790.06. 41 2. A Class “C” or Class “CC” licensee who does not have a 42 Class “G” license but who is a retired law enforcement officer; 43 who separated from service in good standing; who, before such 44 separation, served as a law enforcement officer for at least 10 45 years; and who maintains her or his annual firearms proficiency 46 qualification may carry a concealed firearm in the performance 47 of her or his duties. However, such licensee must have a valid 48 federal Law Enforcement Officers Safety Act qualification card 49 in her or his possession at all times while carrying a concealed 50 firearm on duty. 51 (4) A Class “C” or Class “CC” licensee who is 21 years of 52 age or older and has also been issued a Class “G” license, who 53 has a license to carry concealed firearms, or who meets the 54 requirements of subparagraph (2)(b)2. may carry, in the 55 performance of her or his duties, a concealed firearm. A Class 56 “D” licensee who is 21 years of age or older and has also been 57 issued a Class “G” license may carry a concealed firearm in the 58 performance of her or his duties under the conditions specified 59 in s. 493.6305(3) and (4). The Class “G” license must clearly 60 indicate such authority. The authority of any such licensee to 61 carry a concealed firearm is valid in any location throughout 62 the state while performing services within the scope of the 63 license. 64 Section 3. This act shall take effect July 1, 2021.
