House Comm: UNFAV . 03/23/2021 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Commerce and Tourism (Taddeo) recommended the following: 1 Senate Amendment to Amendment (482404) (with title 2 amendment) 3 4 Delete lines 757 - 792 5 and insert: 6 501.177 Department of Legal Affairs; rules.— 7 (1) The Department of Legal Affairs shall adopt rules to 8 enforce this act. If the department has reason to believe that a 9 business, directly or indirectly, has violated or is violating 10 this section, the department may institute an appropriate legal 11 proceeding against the business. 12 (2) The trial court, upon a showing that any business, 13 directly or indirectly, has violated or is violating this act, 14 may take any of the following actions: 15 (a) Issue a temporary or permanent injunction. 16 (b) Impose a civil penalty not to exceed $5,000 for each 17 violation. If the violation involves a consumer who was 16 years 18 of age or younger at the time of the violation, the court may 19 triple the civil penalty. 20 (c) Award reasonable costs of enforcement, including a 21 reasonable attorney fee and costs. 22 (d) Grant such other relief as the court may deem 23 appropriate. 24 25 ================= T I T L E A M E N D M E N T ================ 26 And the title is amended as follows: 27 Delete lines 853 - 855 28 and insert: 29 s. 501.177, F.S.; requiring the Department of Legal 30 Affairs to
