       The Committee on Rules (Gruters) recommended the following:
       
    1         Senate Amendment to Amendment (655390) 
    2  
    3         Delete lines 424 - 439
    4  and insert:
    5  collected the consumer’s personal information from offering a
    6  different price, rate, level, quality, or selection of goods or
    7  services to a consumer, including offering goods or services for
    8  no fee, if the consumer has opted out of targeted advertising or
    9  the sale of his or her personal information.
   10         (c) This act may not be construed to require a business to
   11  provide a product or service that requires the personal data of
   12  a consumer which the business does not collect or maintain, or
   13  to prohibit a business from offering a different price, rate,
   14  level, quality, or selection of goods or services to a consumer,
   15  including offering goods or services for no fee, if the offer is
   16  related to a consumer’s voluntary participation in a loyalty,
   17  reward, premium features, discounts, or club card program.
