Florida Senate - 2021 SB 1836 By Senator Polsky 29-00589B-21 20211836__ 1 A bill to be entitled 2 An act relating to public records; amending s. 3 24.1051, F.S.; exempting from public records the names 4 of lottery winners who win prizes over a specified 5 value; providing for future legislative review and 6 repeal of the exemption; providing a statement of 7 public necessity; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Present subsections (3) and (4) of section 12 24.1051, Florida Statutes, are redesignated as subsections (4) 13 and (5), respectively, and a new subsection (3) is added to that 14 section, to read: 15 24.1051 Exemptions from inspection or copying of public 16 records.— 17 (3)(a) The name of a winner of a prize valued at $250,000 18 or more is confidential and exempt from s. 119.07(1) and s. 19 24(a), Art. I of the State Constitution, unless the winner 20 consents to the release of his or her name or as provided for in 21 s. 24.115(4) or s. 409.2577. 22 (b) This subsection is subject to the Open Government 23 Sunset Review Act in accordance with s. 119.15 and shall stand 24 repealed on October 2, 2026, unless reviewed and saved from 25 repeal through reenactment by the Legislature. 26 Section 2. The Legislature finds that it is a public 27 necessity that the name of a winner of a lottery prize valued at 28 $250,000 or more be made confidential and exempt from s. 29 119.07(1), Florida Statutes, and s. 24(a), Article I of the 30 State Constitution, because persons who win valuable lottery 31 prizes have been the targets of violent and nonviolent criminal 32 acts based upon publicly available identifying information. For 33 this reason, the Legislature finds that it is a public necessity 34 to maintain the confidential and exempt status of such 35 information. 36 Section 3. This act shall take effect upon becoming a law.
