Senator Rodriguez moved the following:

4 insert:
5 Section 1. Subsection (4) of section 373.4149, Florida
6 Statutes, is amended to read:
7 373.4149 Miami-Dade County Lake Belt Plan.—
8 (4) The identification of the Miami-Dade County Lake Belt
9 Area shall not preempt local land use jurisdiction, planning, or
10 regulatory authority in regard to the use of land by private
11 land owners. When amending local comprehensive plans, or
12 implementing zoning regulations, development regulations, or
13 other local regulations, Miami-Dade County shall strongly
14 consider limestone mining activities and ancillary operations,
15 such as lake excavation, including use of explosives, rock
16 processing, cement, concrete and asphalt products manufacturing,
17 and ancillary activities, within the rock mining supported and
18 allowable areas of the Miami-Dade County Lake Belt Plan adopted
19 by subsection (1); provided, however, that limerock mining
20 activities are consistent with wellfield protection. Rezonings,
21 amendments to local zoning and subdivision regulations, and
22 amendments to local comprehensive plans concerning properties
23 that are located within 1 mile of the Miami-Dade County Lake
24 Belt Area shall be compatible with limestone mining activities.
25 No rezonings, variances, amendments to local zoning and
26 subdivision regulations which would result in an increase in
27 residential density, or amendments to local comprehensive plans
28 for any residential purpose, except for residential uses
29 supporting transit-oriented development, may be approved for any
30 property located in sections 35 and 36 and the east one-half of
31 sections 24 and 25, Township 53 South, Range 39 East until such
32 time as there is no active mining within 2 miles of the
33 property. This section does not preclude residential development
34 that complies with current regulations.
