    2         An act relating to Medicaid eligibility; amending s.
    3         409.903, F.S.; revising the period of eligibility for
    4         Medicaid for postpartum women; providing an effective
    5         date.
    6          
    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Subsection (5) of section 409.903, Florida
   10  Statutes, is amended to read:
   11         409.903 Mandatory payments for eligible persons.—The agency
   12  shall make payments for medical assistance and related services
   13  on behalf of the following persons who the department, or the
   14  Social Security Administration by contract with the Department
   15  of Children and Families, determines to be eligible, subject to
   16  the income, assets, and categorical eligibility tests set forth
   17  in federal and state law. Payment on behalf of these Medicaid
   18  eligible persons is subject to the availability of moneys and
   19  any limitations established by the General Appropriations Act or
   20  chapter 216.
   21         (5) A pregnant woman for the duration of her pregnancy and
   22  for the postpartum period as defined in federal law and rule or
   23  consisting of the 365-day period beginning on the last day of
   24  her pregnancy, whichever is longer, or a child under age 1, if
   25  either is living in a family that has an income that which is at
   26  or below 150 percent of the most current federal poverty level,
   27  or, effective January 1, 1992, that has an income which is at or
   28  below 185 percent of the most current federal poverty level.
   29  Such a person is not subject to an assets test. Further, a
   30  pregnant woman who applies for eligibility for the Medicaid
   31  program through a qualified Medicaid provider must be offered
   32  the opportunity, subject to federal rules, to be made
   33  presumptively eligible for the Medicaid program.
   34         Section 2. This act shall take effect July 1, 2021.
