Floor: 1/AD/2R . 04/21/2021 12:29 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Hooper moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 17 - 40 4 and insert: 5 (1) A private passenger motor vehicle policy may exclude 6 the following coverages for all claims or suits resulting from 7 the operation of a motor vehicle by an identified individual who 8 is not a named insured, provided the identified individual is 9 named on the declarations page or by endorsement and the named 10 insured consents in writing to such exclusion: 11 (a) Notwithstanding the Florida Motor Vehicle No-Fault Law, 12 the personal injury protection coverage specifically applicable 13 to the identified individual’s injuries, lost wages, and death 14 benefits. 15 (b) Property damage liability coverage. 16 (c) Bodily injury liability coverage, if required by law 17 and purchased by the named insured. 18 (d) Uninsured motorist coverage for any damages sustained 19 by the identified excluded individual, if the named insured has 20 purchased such coverage. 21 (e) Any coverage the named insured is not required by law 22 to purchase. 23 (2) A private passenger motor vehicle policy may not 24 exclude coverage when: 25 (a) The identified individual is injured while not 26 operating a motor vehicle; 27 (b) The identified individual is being excluded solely 28 because of his or her race, color, religion, sex, national 29 origin, age, handicap, pregnancy, or marital status; or 30 31 ================= T I T L E A M E N D M E N T ================ 32 And the title is amended as follows: 33 Delete lines 5 - 6 34 and insert: 35 certain coverages for claims resulting from the 36 operation of motor vehicles by identified individuals 37 under certain circumstances; requiring
