Florida Senate - 2021 SB 460 By Senator Bracy 11-00041-21 2021460__ 1 A bill to be entitled 2 An act relating to early intervention systems for law 3 enforcement officers; creating s. 943.6875, F.S.; 4 providing legislative findings and intent; requiring 5 every law enforcement agency to create an early 6 intervention system to track and identify potentially 7 damaging patterns of behavior by law enforcement 8 officers; providing risk indicators; providing an 9 effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 943.6875, Florida Statutes, is created 14 to read: 15 943.6875 Early intervention systems for law enforcement 16 officers.— 17 (1) The Legislature finds that a small percentage of law 18 enforcement officers is responsible for a disproportionate 19 number of excessive force complaints received by law enforcement 20 agencies. The Legislature also finds that proactive and early 21 identification of that small percentage of law enforcement 22 officers and intervention through mentorship, counseling, and 23 additional training may lead to positive outcomes in the careers 24 of such officers and in their encounters with the public. 25 (2) The Legislature intends for all law enforcement 26 agencies in this state to create early intervention systems to 27 proactively identify law enforcement officers who are likely to 28 engage in potentially damaging behaviors, such as excessive 29 force, before such behaviors occur in order to protect such 30 officers, other law enforcement officers, and the members of the 31 public with whom they interact and to offer intervention through 32 mentorship, counseling, and additional training. 33 (3) Every law enforcement agency in this state shall create 34 an early intervention system to track and identify potentially 35 damaging patterns of behavior by law enforcement officers. 36 (4) Risk indicators to track which may identify potentially 37 damaging patterns of behavior by law enforcement officers 38 include, but need not be limited to: 39 (a) Complaints against an individual law enforcement 40 officer or a group of law enforcement officers. 41 (b) Frequency and severity of disciplinary incidents. 42 (c) Incidents involving use of force. 43 (d) Incidents involving use of deadly force. 44 (e) Arrests made by a law enforcement officer of 45 individuals for resisting arrest. 46 (f) Reports of injuries suffered by a law enforcement 47 officer. 48 (g) Vehicle accidents involving a law enforcement officer. 49 (h) Civil litigation filed against a law enforcement 50 officer. 51 Section 2. This act shall take effect July 1, 2021.
