       Senator Burgess moved the following:
       
    1         Senate Amendment to Amendment (824756) (with title
    2  amendment)

    4         Delete lines 1283 - 1294
    5  and insert:
    6         (10) DAMAGES.—If the trier of fact finds that the party
    7  bringing the bad faith claim has met its burden of proof, the
    8  insurer is liable for the amount of any excess judgment,
    9  together with court costs and, if the party bringing the bad
   10  faith claim is the insured or an assignee of the insured, the
   11  reasonable attorney fees incurred by the party bringing the bad
   12  faith claim. Punitive damages may not be awarded.
