Florida Senate - 2021 SB 632 By Senator Torres 15-00615-21 2021632__ 1 A bill to be entitled 2 An act relating to marriage equality; repealing s. 3 741.212, F.S., relating to marriages between persons 4 of the same sex; removing a prohibition on the 5 recognition of marriages entered into between persons 6 of the same sex in this state, another state, or 7 another jurisdiction, either domestic or foreign; 8 removing a prohibition on giving effect to any public 9 act, record, or judicial proceeding of another 10 jurisdiction respecting a marriage or relationship not 11 recognized in this state or a claim arising from such 12 a marriage or relationship; removing the definition of 13 the term “marriage,” which limits marriage only to a 14 legal union between one man and one woman; providing a 15 directive to the Division of Law Revision; providing 16 an effective date. 17 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Section 741.212, Florida Statutes, is repealed. 21 Section 2. The Division of Law Revision is directed to 22 prepare a reviser’s bill for the 2022 Regular Session of the 23 Legislature to change the terms “husband” and “wife” to 24 “spouse,” the term “husband and wife” to “spouses,” and the term 25 “husband or wife” to “either spouse” wherever those terms appear 26 in the Florida Statutes. 27 Section 3. This act shall take effect upon becoming a law.
