       Senator Brodeur moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 51 and 52
    4  insert:
    5         Section 4. Effective upon HB 403 or other similar
    6  legislation being enacted in the 2021 Regular Session or an
    7  extension thereof and becoming a law, subsection (6) of section
    8  500.80, Florida Statutes, as amended by this act, is amended to
    9  read:
   10         500.80 Cottage food operations.—
   11         (6) The regulation of cottage food operations is preempted
   12  to the state. A local law, ordinance, or regulation may not
   13  prohibit a cottage food operation or regulate the preparation,
   14  processing, storage, or sale of cottage food products by a
   15  cottage food operation; however, a cottage food operation must
   16  comply with the conditions for the operation of a home-based
   17  business under s. 559.955 or from a person’s residence.
