The Committee on Transportation (Harrell) recommended the
following:

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Paragraph (a) of subsection (10) of section
6 320.08056, Florida Statutes, is amended to read:
7 320.08056 Specialty license plates.—
8 (10)(a) A specialty license plate annual use fee collected
9 and distributed under this chapter, or any interest earned from
10 those fees, may not be used for commercial or for-profit
11 activities nor for general or administrative expenses, except as
12 authorized by s. 320.08058 or to pay the cost of the audit or
13 report required by s. 320.08062(1). The fees and any interest
14 earned from the fees may be expended only for use in this state
15 unless the annual use fee is derived from the sale of United
16 States Armed Forces and veterans-related specialty license
17 plates pursuant to paragraph (3)(d) for the Support Our Troops,
18 and American Legion, and Honor Flight license plates; paragraphs
19 (4)(b), (q), and (v) for the Florida Salutes Veterans, United
20 States Marine Corps, and Military Services license plates,
21 respectively; and s. 320.0891 for the U.S. Paratrooper license
22 plate.
23 Section 2. Subsections (10), (46), and (101) of section
24 320.08058, Florida Statutes, are amended, and subsections (112)
25 through (123) are added to that section, to read:
26 320.08058 Specialty license plates.—
27 (10) FLORIDA INDIAN RIVER LAGOON LICENSE PLATES.—
28 (a) Because the Indian River Lagoon system has been
29 targeted by the state as a priority water body for restoration
30 and preservation since the 1987 Surface Water Improvement and
31 Management Act, and because the St. Johns River and South
32 Florida Water Management Districts have joined with local,
33 regional, and state partners to create the Indian River Lagoon
34 (IRL) Council by Interlocal Agreement in 2015 to serve as the
35 host agency for the Indian River Lagoon National Estuary
36 Program, and because the program has worked with local, state,
37 and federal partners to develop and adopt the Indian River
38 Lagoon Comprehensive Conservation and Management Plan in 2019,
39 and because the St. Johns River Water Management District has
40 been distributing funds collected from the plate from Volusia,
41 Brevard, and Indian River Counties to support competitive local
42 cost-share projects in each of these counties administered by
43 the IRL Council, including jointly developed a management plan
44 that includes water quality improvement, habitat restoration,
45 and public awareness and education, and because the United
46 States Environmental Protection Agency has declared the Indian
47 River Lagoon to be an estuary of national significance, and
48 because coastal lagoon activities relating to saltwater fishing
49 account for a multibillion dollar economic base, and because the
50 Legislature supports the restoration efforts of the Indian River
51 Lagoon National Estuary Program and its partners water
52 management districts, the Legislature intends for the
53 establishes a Florida Indian River Lagoon license plate to
54 provide for the purpose of providing a continuous funding source
55 to support this worthwhile effort and to heighten public
56 awareness of this economically significant resource. Florida
57 Indian River Lagoon license plates must contain the fish
58 “snook,” which has been used as the Indian River Lagoon Surface
59 Water Improvement and Management logo, suspended over seagrass,
60 and must bear the colors and design approved by the department.
61 (b) The license plate annual use fees are to be distributed
62 annually as follows:
63 1. The first $5 million collected annually must be
64 transferred to the IRL Council, which must separately St. Johns
65 River Water Management District. The district shall account for
66 the transferred these funds, and such separate from all other
67 funds received. These funds must be distributed as follows:
68 a. Based on Florida Indian River Lagoon license plate sales
69 data from each county tax collector for Volusia, Brevard, Indian
70 River, St. Lucie, Martin, and Palm Beach Counties, each county’s
71 total number of Florida Indian River Lagoon license plates sold
72 between October 1 and September 30 must represent a percentage
73 of the six-county total, calculated as follows: the total number
74 sold for county A divided by the total number sold for counties
75 A, B, C, D, E, and F is multiplied by 100. The percentage
76 determined for St. Lucie, Martin, and Palm Beach Counties must
77 be totaled, and that total percentage of the statewide Florida
78 Indian River Lagoon license plate revenues must be transferred
79 to the South Florida Water Management District special Indian
80 River Lagoon License Plate Revenue Account and distributed
81 proportionately among St. Lucie, Martin, and Palm Beach
82 Counties. The remaining funds in the IRL Council St. Johns River
83 Water Management District Revenue Account must be divided
84 proportionately between Volusia, Brevard, and Indian River
85 Counties.
86 b. The IRL Council shall administer Each water management
87 district is responsible for administering projects in Volusia,
88 Brevard, and Indian River its respective Counties from funds
89 derived from funded with the appropriate percentage of license
90 plate revenues. The South Florida Water Management District
91 shall administer projects in St. Lucie, Martin, and Palm Beach
92 Counties.
93 2. Up to 5 percent of the proceeds from the annual use fee
94 may be used for continuing promotion and marketing of the
95 license plate.
96 3. Any additional fees must be deposited into the General
97 Revenue Fund. Fees are not to be deposited into the general
98 revenue funds of the IRL Council water management districts.
99 (c) The application of Florida Indian River Lagoon license
100 plate annual use fees is to be administered by the IRL Council
101 St. Johns River and the South Florida Water Management District
102 Districts for Indian River Lagoon projects and in accordance
103 with their contracting and purchasing policies and procedures,
104 with the following restrictions:
105 1. An annual amount of the total license plate use fees
106 must be earmarked for each of the six lagoon basin counties, as
107 determined in sub-subparagraph (b)1.a., to be expended in those
108 counties on habitat restoration, including water quality
109 improvement, monitoring, and environmental education projects.
110 At least 80 percent of the use fees must be used for restoration
111 projects, and not more than 20 percent may be used for
112 environmental education and monitoring projects in each county.
113 These project funds may serve as matching funds for other local,
114 state, or federal funds or grants. Unencumbered funds from one
115 year may be carried over to the following year but must be
116 dedicated to a project within 2 years in the form of a contract,
117 an interlocal agreement, or an approved plan by the governing
118 board of the respective district.
119 2. Florida Indian River Lagoon license plate annual use
120 fees may not be used for administrative salaries or overhead
121 within the IRL Council or the South Florida Water Management
122 District; the water management districts, nor for any general
123 coordination fees or overhead that outside of the districts
124 which is not specifically related to a project;, nor for any
125 projects which are considered to be research, studies,
126 inventories, or evaluations; or, nor for administrative salaries
127 or overhead related to environmental education or ongoing
128 regular maintenance. Annual use fees may be used for acquisition
129 of rights-of-way specific to the implementation of restoration
130 or improvement projects, if acquisition expenditures do not
131 exceed 20 percent of a county’s appropriation.
132 3. In Volusia County, project implementation may occur in
133 all estuarine waters extending north to and including the Indian
134 River Lagoon National Estuary Program’s Indian River Lagoon
135 Halifax River planning boundary amendments that include the
136 Tomoka Basin.
137 4. In Palm Beach County, first priority must be given to
138 projects within the Indian River Lagoon. Second priority must be
139 given to projects within adjacent estuarine waters, including
140 the Loxahatchee River and other tributaries to the Indian River
141 Lagoon.
142 (d) It is the intent of the Legislature that revenues
143 generated by the Florida Indian River Lagoon license plate
144 annual use fees must not be used as replacement funds for other
145 available funding sources Surface Water Improvement and
146 Management Act funds, but must be used solely for the
147 enhancement of the Indian River Lagoon and tributaries in the
148 Indian River Lagoon watershed as defined by the Indian River
149 Lagoon National Estuary Program project boundary defined in the
150 Indian River Lagoon Comprehensive Conservation and Management
151 Plan or as provided in this section area.
152 (46) WILDLIFE FOUNDATION OF FLORIDA LICENSE PLATES.—
153 (a) The department shall develop a Wildlife Foundation of
154 Florida license plate as provided in this section. The word
155 “Florida” must appear at the top of the plate, and the words
156 “Wildlife Foundation of Florida” must appear at the bottom of
157 the plate.
158 (b) The annual revenues from the sales of the license plate
159 shall be distributed to the Fish & Wildlife Foundation of
160 Florida, Inc., a citizen support organization created pursuant
161 to s. 379.223. Such annual revenues must be used in the
162 following manner:
163 1. Seventy-five percent must be encumbered used to fund
164 programs and projects within the state that preserve open space
165 and wildlife habitat, promote conservation, promote hunting and
166 shooting sports, improve wildlife habitat, and establish open
167 space for the perpetual use of the public. Unencumbered funds
168 from one year may be carried over to the following year, but
169 must be spent within 2 years of receipt or dedicated to a
170 project within 2 years of receipt in the form of a contract, a
171 grant award, or an approved plan by the governing board of the
172 Fish & Wildlife Foundation of Florida, Inc.
173 2. Twenty-five percent may be used for promotion,
174 marketing, and administrative costs directly associated with
175 operation of the foundation.
176 (c) When the provisions of subparagraph (b)1. are met,
177 those annual revenues shall be used for the purposes of
178 subparagraph (b)2.
179 (101) DIVINE NINE LICENSE PLATES.—
180 (a) The department shall develop a Divine Nine license
181 plate as provided in this section and s. 320.08053 using a
182 standard template and a unique logo, graphic, or color for each
183 of the organizations listed in sub-subparagraphs (b)3.a.-i.
184 (b)2.a.-i. The plate must bear the colors and design approved by
185 the department, and must include the official logo, graphic, or
186 color as appropriate for each organization. The word “Florida”
187 must appear at the top of the plate, and the words “Divine Nine”
188 must appear at the bottom of the plate.
189 (b) The annual use fees from the sale of the plate shall be
190 distributed as follows:
191 1. Five percent of the proceeds shall be distributed to the
192 United Negro College Fund, Inc., for college scholarships for
193 Florida residents attending Florida’s historically black
194 colleges and universities.
195 2. Ten percent of the proceeds shall be distributed to the
196 Association to Preserve African-American Society, History, and
197 Tradition, Inc., solely for the marketing of the plate.
198 3.2. The remaining 85 95 percent of the proceeds shall be
199 distributed to one of the following organizations as selected by
200 the purchaser of the plate who, upon fulfilling the requirements
201 of paragraph (c), shall receive a license plate with the logo,
202 graphic, or color associated with the appropriate recipient
203 organization:
204 a. Alpha Phi Alpha Fraternity, Inc.—
205 (I) Eighty-five percent shall be distributed to the Florida
206 Federation of Alpha Chapters, Inc., to promote community
207 awareness and action through educational, economic, and cultural
208 service activities within this state.
209 (II) Ten percent shall be distributed to the Florida
210 Federation of Alpha Chapters, Inc., solely for the marketing of
211 the plate.
212 b. Alpha Kappa Alpha Sorority, Inc.—
213 (I) Eighty-five percent shall be distributed to the Alpha
214 Kappa Alpha Educational Advancement Foundation, Inc., to promote
215 community awareness and action through educational, economic,
216 and cultural service activities within this state.
217 (II) Ten percent shall be distributed to the Alpha Kappa
218 Alpha Educational Advancement Foundation, Inc., solely for the
219 marketing of the plate.
220 c. Kappa Alpha Psi Fraternity, Inc.—
221 (I) Eighty-five percent shall be distributed to the
222 Southern Province of Kappa Alpha Psi Fraternity, Inc., to
223 promote community awareness and action through educational,
224 economic, and cultural service activities within this state.
225 (II) Ten percent shall be distributed to the Southern
226 Province of Kappa Alpha Psi Fraternity, Inc., solely for the
227 marketing of the plate.
228 d. Omega Psi Phi Fraternity, Inc.—
229 (I) Eighty-five percent shall be distributed to the State
230 of Florida Omega Friendship Foundation, Inc., to promote
231 community awareness and action through educational, economic,
232 and cultural service activities within this state.
233 (II) Ten percent shall be distributed to the State of
234 Florida Omega Friendship Foundation, Inc., solely for the
235 marketing of the plate.
236 e. Delta Sigma Theta Sorority, Inc.—
237 (I) Eighty-five percent shall be distributed to the Delta
238 Research and Educational Foundation, Inc., to promote community
239 awareness and action through educational, economic, and cultural
240 service activities within this state.
241 (II) Ten percent shall be distributed to the Delta Research
242 and Educational Foundation, Inc., solely for the marketing of
243 the plate.
244 f. Phi Beta Sigma Fraternity, Inc.—
245 (I) Eighty-five percent shall be distributed to the TMB
246 Charitable Foundation, Inc., to promote community awareness and
247 action through educational, economic, and cultural service
248 activities within this state.
249 (II) Ten percent shall be distributed to the TMB Charitable
250 Foundation, Inc., solely for the marketing of the plate.
251 g. Zeta Phi Beta Sorority, Inc.—
252 (I) Eighty-five percent shall be distributed to the Florida
253 Pearls, Inc., to promote community awareness and action through
254 educational, economic, and cultural service activities within
255 this state.
256 (II) Ten percent shall be distributed to the Florida
257 Pearls, Inc., solely for the marketing of the plate.
258 h. Sigma Gamma Rho Sorority, Inc.—
259 (I) Eighty-five percent shall be distributed to the Sigma
260 Gamma Rho Sorority National Education Fund, Inc., to promote
261 community awareness and action through educational, economic,
262 and cultural service activities within this state.
263 (II) Ten percent shall be distributed to the Sigma Gamma
264 Rho Sorority National Education Fund, Inc., solely for the
265 marketing of the plate.
266 i. Iota Phi Theta Fraternity, Inc.—
267 (I) Eighty-five percent shall be distributed to the
268 National Iota Foundation, Inc., to promote community awareness
269 and action through educational, economic, and cultural service
270 activities within this state.
271 (II) Ten percent shall be distributed to the National Iota
272 Foundation, Inc., solely for the marketing of the plate.
273 (c)1. To be eligible for issuance of a Divine Nine license
274 plate representing an organization listed in sub-subparagraphs
275 (b)3.a.-i., a person must be a resident of this state who is the
276 registered owner of a motor vehicle and who is a member of the
277 applicable organization. The person must also present proof of
278 membership in the organization, which may be established by:
279 a. A card distributed by the organization indicating the
280 person’s membership in the organization; or
281 b. A written letter on the organization’s letterhead which
282 is signed by the organization’s national president or his or her
283 designated official and which states that the person was
284 inducted into the organization.
285 2. Proof of membership in an organization listed in sub
286 subparagraphs (b)3.a.-i. is required only for initial issuance
287 of a Divine Nine license plate. A person need not present such
288 proof for renewal of the license plate.
289 (d) A Divine Nine license plate:
290 1. May be personalized.
291 2. Notwithstanding any other law to the contrary, may be
292 displayed on a privately owned passenger motor vehicle, pickup
293 truck, motorcycle, boat, or pleasure motor vehicle, including,
294 but not limited to, a recreational vehicle.
295 3. May not be transferred between vehicle owners.

297 License plates created pursuant to this subsection shall have
298 their plate sales combined for the purpose of meeting the
299 minimum license plate sales threshold in s. 320.08056(8)(a) and
300 for determining the license plate limit in s. 320.08053(3)(b).
301 License plates created pursuant to this subsection must be
302 ordered directly from the department.
303 (112) FLORIDA STATE PARKS LICENSE PLATES.—
304 (a) The department shall develop a Florida State Parks
305 license plate as provided in this section and s. 320.08053. The
306 plate must bear the colors and design approved by the
307 department. The word “Florida” must appear at the top of the
308 plate, and the words “Explore Our State Parks” must appear at
309 the bottom of the plate.
310 (b) The annual use fees from the sale of the plate shall be
311 distributed to the Florida State Parks Foundation, Inc., a
312 nonprofit Florida corporation under s. 501(c)(3) of the Internal
313 Revenue Code, to be used to preserve, protect, sustain, and grow
314 Florida state parks. Up to 10 percent of the proceeds may be
315 used for marketing of the plate and costs directly associated
316 with administration of the foundation.
317 (113) SUPPORT HEALTHCARE HEROES LICENSE PLATES.-
318 (a) The department shall develop a Support Healthcare
319 Heroes license plate as provided in this section and s.
320 320.08053. The plate must bear the colors and design approved by
321 the department. The word “Florida” must appear at the top of the
322 plate, and the words “Support Healthcare Heroes” must appear at
323 the bottom of the plate.
324 (b) The annual use fees from the sale of the plate shall be
325 distributed annually into the Emergency Medical Services Trust
326 Fund within the Department of Health to provide financial
327 support for prehospital medical services pursuant to s. 401.113.
328 (114) INTER MIAMI CF LICENSE PLATES.—
329 (a) The department shall develop an Inter Miami CF license
330 plate as provided in this section and s. 320.08053. The plate
331 must bear the colors and design approved by the department. The
332 word “Florida” must appear at the top of the plate, and the
333 words “Inter Miami CF” must appear at the bottom of the plate.
334 (b) The license plate annual use fees shall be distributed
335 to Inter Miami CF Foundation Corporation, a nonprofit
336 corporation under s. 501(c)(3) of the Internal Revenue Code,
337 which may use a maximum of 10 percent of the proceeds to promote
338 and market the plate. The remainder of the proceeds shall be
339 used by Inter Miami CF Foundation Corporation to plan and
340 execute sports-based development and direct-service community
341 programs, initiatives, and events.
342 (115) TOASTMASTERS LICENSE PLATES.—
343 (a) The department shall develop a Toastmasters license
344 plate as provided in this section and s. 320.08053. The plate
345 must bear the colors and design approved by the department. The
346 word “Florida” must appear at the top of the plate, and the
347 words “www.Toastmasters.org” must appear at the bottom of the
348 plate.
349 (b) The annual use fees from the sale of the plate shall be
350 distributed to the Ralph C. Smedley Memorial Fund of
351 Toastmasters International, a s. 501(c)(3) nonprofit
352 organization, of which:
353 1. Twenty-five percent shall be used to develop charitable
354 and educational programs for the indigent, homeless, visually
355 and hearing disabled, incarcerated, and youth populations that
356 are unable to afford or to participate in established
357 Toastmasters programs. Up to 5 percent of this distribution may
358 be used for administrative expenses.
359 2. Seventy-five percent shall be proportionally
360 redistributed to the divisions of Districts 47, 48, 77, and 84
361 of Toastmasters International which reside in this state. Up to
362 5 percent of this distribution may be used for marketing of the
363 plate, and the remainder shall be used for educators,
364 nonprofits, governmental organizations, scholarships, materials,
365 and computers and other equipment for the purpose of
366 implementing the charitable and educational programs for the
367 indigent, homeless, visually and hearing disabled, incarcerated,
368 and youth populations that are unable to afford or to
369 participate in the established Toastmasters programs.
370 (116) GOPHER TORTOISE LICENSE PLATES.—
371 (a) The department shall develop a Gopher Tortoise license
372 plate as provided in this section and s. 320.08053. The plate
373 must bear the colors and design approved by the department. The
374 word “Florida” must appear at the top of the plate, and the
375 words “Protect the Gopher Tortoise” must appear at the bottom of
376 the plate.
377 (b) The annual use fees from the sale of the plate shall be
378 distributed to Wildlands Conservation, Inc., a nonprofit
379 corporation under s. 501(c)(3) of the Internal Revenue Code, to
380 fund gopher tortoise and commensal species research, education,
381 and conservation, as well as upland habitat protection,
382 restoration, and management in this state. Up to 15 percent of
383 the funds received by Wildlands Conservation, Inc., may be used
384 for marketing of the plate and costs directly associated with
385 the administration of the gopher tortoise protection program.
386 Wildlands Conservation, Inc., shall use and distribute the funds
387 to eligible Florida-based scientific, conservation, and
388 educational organizations for gopher tortoise and upland habitat
389 research, conservation, and management.
390 (117) ORLANDO UNITED LICENSE PLATES.—
391 (a) The department shall develop an Orlando United license
392 plate as provided in this section and s. 320.08053. The plate
393 must bear the colors and design approved by the department. The
394 word “Florida” must appear at the top of the plate, and the
395 words “Orlando United” must appear at the bottom of the plate.
396 (b) The annual use fees from the sale of the plate shall be
397 distributed as follows:
398 1. Five percent shall be distributed to the Mental Health
399 Association of Central Florida, Inc., to be used for marketing
400 of the license plate.
401 2. Thirty-one percent shall be distributed to the Mental
402 Health Association of Central Florida, Inc. Of this amount, up
403 to 5 percent may be used for administrative expenses, and the
404 remainder shall be used to offer free personalized counseling to
405 any person affected by the shooting at the Pulse nightclub in
406 Orlando on June 12, 2016.
407 3. Two percent shall be distributed to onePULSE Foundation,
408 Inc., a charitable, nonprofit organization under s. 501(c)(3) of
409 the Internal Revenue Code, to be used for marketing of the
410 license plate.
411 4. Thirty-one percent shall be distributed to onePULSE
412 Foundation, Inc. Of this amount, up to 5 percent may be used for
413 administrative expenses, and the remainder shall be used to
414 support the construction and maintenance of the onePULSE
415 Foundation Memorial.
416 5. Thirty-one percent shall be distributed to Two Spirit
417 Health Services, Inc. Of this amount, up to 5 percent may be
418 used for administrative expenses, and the remainder shall be
419 used to offer free personalized counseling to any person
420 affected by the shooting at the Pulse nightclub in Orlando on
421 June 12, 2016.
422 (118) BISCAYNE BAY LICENSE PLATES.—
423 (a) The department shall develop a Biscayne Bay license
424 plate as provided in this section and s. 320.08053. The plate
425 must bear the colors and design approved by the department. The
426 word “Florida” must appear at the top of the plate, and the
427 words “Protect Biscayne Bay” must appear at the bottom of the
428 plate.
429 (b) The annual use fees from the sale of the plate shall be
430 distributed to The Miami Foundation, Inc., a Florida nonprofit
431 corporation, to be used as follows:
432 1. Up to 10 percent of the fees may be used for promotion
433 and marketing of the license plate and for direct reimbursement
434 for administrative costs, startup costs, and costs incurred in
435 the development and approval process of the license plate. All
436 vendors associated with administrative costs shall be selected
437 by competitive bid.
438 2. The remaining fees shall be used to raise awareness and
439 support the mission and efforts of conserving Biscayne Bay. The
440 Miami Foundation Board of Trustees must approve and is
441 accountable for all such expenditures.
442 (119) DISEASE PREVENTION & EARLY DETECTION LICENSE PLATES.—
443 (a) The department shall develop a Disease Prevention &
444 Early Detection license plate as provided in this section and s.
445 320.08053. The plate must bear the colors and design approved by
446 the department. The word “Florida” must appear at the top of the
447 plate, and the words “Disease Prevention & Early Detection” must
448 appear at the bottom of the plate.
449 (b) The license plate annual use fees shall be distributed
450 to The Women’s Breast & Heart Initiative, Florida Affiliate,
451 Inc., a Florida nonprofit corporation, which may use a maximum
452 of 10 percent of the proceeds to promote and market the plate.
453 The remainder of the proceeds shall be used by The Women’s
454 Breast & Heart Initiative, Florida Affiliate, Inc., to provide
455 increased education and awareness relating to early detection,
456 prevention, and screening of breast and heart issues.
457 (120) HONOR FLIGHT LICENSE PLATES.—
458 (a) The department shall develop an Honor Flight license
459 plate as provided in this section and s. 320.08053. The plate
460 must bear the colors and design approved by the department. The
461 word “Florida” must appear at the top of the plate, and the
462 words “Honor Flight” must appear at the bottom of the plate.
463 (b) The annual use fees from the sale of the plate shall be
464 distributed equally among the Honor Flight Network hubs in this
465 state, each of which is a nonprofit corporation under s.
466 501(c)(3) of the Internal Revenue Code, to be used as follows:
467 1. Up to 10 percent of the fees may be used for promotion
468 and marketing of the license plate.
469 2. The remaining fees shall be used to further the Honor
470 Flight Network’s mission of transporting military veterans to
471 Washington, D.C., in order to visit the memorials dedicated to
472 honoring those who have served and sacrificed for the United
473 States.
474 (121) ETHICAL ECOTOURISM LICENSE PLATES.—
475 (a) The department shall develop an Ethical Ecotourism
476 license plate as provided in this section and s. 320.08053. The
477 word “Florida” must appear at the top of the plate, and words
478 approved by the department must appear at the bottom of the
479 plate.
480 (b) The annual use fees from the sale of the plate must be
481 distributed equally between the Florida Society for Ethical
482 Ecotourism and Paddle Florida, Inc., each of which may use up to
483 10 percent of such proceeds for administrative costs and the
484 marketing of the plate. The remaining proceeds must be used by
485 the Florida Society for Ethical Ecotourism to provide
486 environmental education and awareness that encourage behaviors
487 that contribute to the sustainability of Florida’s natural
488 ecosystems and resources and by Paddle Florida, Inc., to raise
489 awareness about water conservation, wildlife preservation,
490 restoration of springs, and protection of waterways in this
491 state.
492 (122) PROTECT MARINE WILDLIFE LICENSE PLATES.—
493 (a) The department shall develop a Protect Marine Wildlife
494 license plate as provided in this section and s. 320.08053. The
495 plate must bear the colors and design approved by the
496 department. The word “Florida” must appear at the top of the
497 plate, and the words “Protect Marine Wildlife” must appear at
498 the bottom of the plate.
499 (b)1. The department shall retain all annual use fees from
500 the sale of the plate until all startup costs for developing and
501 issuing the plate have been recovered.
502 2. Thereafter, up to 10 percent of the annual use fee
503 revenue may be used for administration, promotion, and marketing
504 of the specialty license plate. All remaining proceeds shall be
505 used by the Protect Wild Dolphins Alliance, Inc., to fund its
506 conservation, research, and educational programs that focus on
507 the conservation of Florida’s threatened and protected marine
508 wildlife species.
509 (123) MARGARITAVILLE LICENSE PLATES.—
510 (a) The department shall develop a Margaritaville license
511 plate as provided in this section and s. 320.08053. The plate
512 must bear the colors and design approved by the department. The
513 word “Florida” must appear at the top of the plate, and the word
514 “Margaritaville” must appear at the bottom or the side of the
515 plate.
516 (b)1. The department shall retain all annual use fees from
517 the sale of the plate until all startup costs for developing and
518 issuing the plate have been recovered.
519 2. Thereafter, up to 10 percent of the annual use fee
520 revenue may be used for administration, promotion, and marketing
521 of the specialty license plate. All remaining proceeds shall be
522 used by the SFC Charitable Foundation, Inc., to provide grants
523 to nonprofit organizations in communities impacted by natural or
524 manmade disasters for purposes of recovery, rebuilding, and
525 future sustainability and to promote and inspire local
526 grassroots leaders who work to improve the quality of life in
527 those communities and other communities in this state.
528 Section 3. Subsection (5) of section 320.0807, Florida
529 Statutes, is amended to read:
530 320.0807 Special license plates for Governor and federal
531 and state legislators.—
532 (5) Upon application by any current or former President of
533 the Senate and payment of the fees prescribed by s. 320.0805,
534 the department may issue a license plate stamped “Senate
535 President” followed by the number assigned by the department or
536 chosen by the applicant if it is not already in use. Upon
537 application by any current or former Speaker of the House of
538 Representatives and payment of the fees prescribed by s.
539 320.0805, the department may issue a license plate stamped
540 “House Speaker” followed by the number assigned by the
541 department or chosen by the applicant if it is not already in
542 use. The applicant must have served as President of the Senate
543 or Speaker of the House of Representatives prior to January 1,
544 2021.
545 Section 4. Section 320.089, Florida Statutes, is amended to
546 read:
547 320.089 Veterans of the United States Armed Forces; members
548 of National Guard; survivors of Pearl Harbor; Purple Heart medal
549 recipients; Bronze Star recipients; active or retired United
550 States Armed Forces reservists; Combat Infantry Badge, Combat

554 Korean War Veterans; Vietnam War Veterans; Operation Desert

556 Enduring Freedom Veterans; Operation Iraqi Freedom Veterans;
557 Women Veterans; World War II Veterans; and Navy Submariners; and
558 Army of Occupation Veterans; special license plates; fee.—
559 (1)(a) Each owner or lessee of an automobile or truck for
560 private use or recreational vehicle as specified in s.
561 320.08(9)(c) or (d), which is not used for hire or commercial
562 use, who is a resident of the state and a veteran of the United
563 States Armed Forces, a Woman Veteran, a World War II Veteran, a
564 Navy Submariner, an active or retired member of the Florida
565 National Guard, a survivor of the attack on Pearl Harbor, a
566 recipient of the Purple Heart medal, a recipient of the Bronze
567 Star, an active or retired member of any branch of the United
568 States Armed Forces Reserve, or a recipient of the Combat
569 Infantry Badge, Combat Medical Badge, Combat Action Badge,
570 Combat Action Ribbon, Air Force Combat Action Medal, or
571 Distinguished Flying Cross, upon application to the department,
572 accompanied by proof of release or discharge from any branch of
573 the United States Armed Forces, proof of active membership or
574 retired status in the Florida National Guard, proof of
575 membership in the Pearl Harbor Survivors Association or proof of
576 active military duty in Pearl Harbor on December 7, 1941, proof
577 of being a Purple Heart medal recipient, proof of being a Bronze
578 Star recipient, proof of active or retired membership in any
579 branch of the United States Armed Forces Reserve, or proof of
580 membership in the Combat Infantrymen’s Association, Inc., proof
581 of being a recipient of the Combat Infantry Badge, Combat
582 Medical Badge, Combat Action Badge, Combat Action Ribbon, Air
583 Force Combat Action Medal, or Distinguished Flying Cross, and
584 upon payment of the license tax for the vehicle as provided in
585 s. 320.08, shall be issued a license plate as provided by s.
586 320.06 which, in lieu of the serial numbers prescribed by s.
587 320.06, is stamped with the words “Veteran,” “Woman Veteran,”
588 “WWII Veteran,” “Navy Submariner,” “National Guard,” “Pearl
589 Harbor Survivor,” “Combat-wounded veteran,” “Bronze Star,” “U.S.
590 Reserve,” “Combat Infantry Badge,” “Combat Medical Badge,”
591 “Combat Action Badge,” “Combat Action Ribbon,” “Air Force Combat
592 Action Medal,” or “Distinguished Flying Cross,” as appropriate,
593 and a likeness of the related campaign medal or badge, followed
594 by the serial number of the license plate. Additionally, the
595 Purple Heart plate may have the words “Purple Heart” stamped on
596 the plate and the likeness of the Purple Heart medal appearing
597 on the plate.
598 (b) The military members listed in paragraph (a) are
599 eligible to be issued special veteran’s motorcycle license
600 plates. The veteran’s motorcycle license plate design shall be
601 the same as the design for the motor vehicle “Veteran” and
602 “Woman Veteran” special license plate. The word “Veteran” or
603 “Woman Veteran” shall be displayed at the bottom of the
604 motorcycle license plate.
605 (c) Notwithstanding any other provision of law to the
606 contrary, beginning with fiscal year 2002-2003 and annually
607 thereafter, the first $100,000 in general revenue generated from
608 the sale of license plates issued under this section shall be
609 deposited into the Grants and Donations Trust Fund, as described
610 in s. 296.38(2), to be used for the purposes established by law
611 for that trust fund. Any additional general revenue generated
612 from the sale of such plates shall be deposited into the
613 Operations and Maintenance Trust Fund within the Department of
614 Veterans’ Affairs and used to support program operations that
615 benefit veterans or the operation, maintenance, or construction
616 of domiciliary and nursing homes for veterans, subject to the
617 requirements of chapter 216.
618 (d) Any revenue generated from the sale of Woman Veteran
619 license plates must be deposited into the Operations and
620 Maintenance Trust Fund administered by the Department of
621 Veterans’ Affairs pursuant to s. 20.375(3) and must be used
622 solely for the purpose of creating and implementing programs to
623 benefit women veterans. Notwithstanding any provisions of law to
624 the contrary, an applicant for a Pearl Harbor Survivor license
625 plate or a Purple Heart license plate who also qualifies for a
626 disabled veteran’s license plate under s. 320.084 shall be
627 issued the appropriate special license plate without payment of
628 the license tax imposed by s. 320.08.
629 (2) Each owner or lessee of an automobile or truck for
630 private use, a truck weighing not more than 7,999 pounds, or a
631 recreational vehicle as specified in s. 320.08(9)(c) or (d),
632 which is not used for hire or commercial use who is a resident
633 of this state and who is a former prisoner of war, or his or her
634 unremarried surviving spouse, upon application to the
635 department, shall be issued a license plate as provided in s.
636 320.06, stamped with the words “Ex-POW” followed by the serial
637 number. Each application shall be accompanied by proof that the
638 applicant meets the qualifications specified in paragraph (a) or
639 paragraph (b).
640 (a) A citizen of the United States who served as a member
641 of the Armed Forces of the United States or the armed forces of
642 a nation allied with the United States who was held as a
643 prisoner of war at such time as the Armed Forces of the United
644 States were engaged in combat, or his or her unremarried
645 surviving spouse, may be issued the special license plate
646 provided for in this subsection without payment of the license
647 tax imposed by s. 320.08.
648 (b) A person who was serving as a civilian with the consent
649 of the United States Government, or a person who was a member of
650 the Armed Forces of the United States while he or she was not a
651 United States citizen and was held as a prisoner of war when the
652 Armed Forces of the United States were engaged in combat, or his
653 or her unremarried surviving spouse, may be issued the special
654 license plate provided for in this subsection upon payment of
655 the license tax imposed by s. 320.08.
656 (3) Each owner or lessee of an automobile or truck for
657 private use, a truck weighing not more than 7,999 pounds, or a
658 recreational vehicle as specified in s. 320.08(9)(c) or (d),
659 which is not used for hire or commercial use who is a resident
660 of this state and who is the unremarried surviving spouse of a
661 recipient of the Purple Heart medal, upon application to the
662 department accompanied by the payment of the required fees,
663 shall be issued a license plate as provided in s. 320.06 which
664 is stamped with the words “Purple Heart” and the likeness of the
665 Purple Heart medal followed by the serial number. Each
666 application shall be accompanied by proof that the applicant is
667 the unremarried surviving spouse of a recipient of the Purple
668 Heart medal.
669 (4) The owner or lessee of an automobile or truck for
670 private use, a truck weighing not more than 7,999 pounds, or a
671 recreational vehicle as specified in s. 320.08(9)(c) or (d)
672 which is not used for hire or commercial use who is a resident
673 of this state and a current or former member of the United
674 States Armed Forces who was deployed and served in Korea during
675 the Korean War as defined in s. 1.01(14), upon application to
676 the department accompanied by proof of active membership or
677 former active duty status during the Korean War and payment of
678 the license tax for the vehicle as provided in s. 320.08, shall
679 be issued a license plate as provided by s. 320.06 which, in
680 lieu of the registration license number prescribed by s. 320.06,
681 is stamped with the words “Korean War Veteran” and a likeness of
682 the Korean Service Medal, followed by the registration license
683 number of the plate. Proof that the applicant was awarded the
684 Korean Service Medal is sufficient to establish eligibility for
685 the license plate.
686 (5) The owner or lessee of an automobile or truck for
687 private use, a truck weighing not more than 7,999 pounds, or a
688 recreational vehicle as specified in s. 320.08(9)(c) or (d)
689 which is not used for hire or commercial use who is a resident
690 of this state and a current or former member of the United
691 States military who was deployed and served in Vietnam during
692 United States military deployment in Indochina, upon application
693 to the department accompanied by proof of active membership or
694 former active duty status during these operations and payment of
695 the license tax for the vehicle as provided in s. 320.08, shall
696 be issued a license plate as provided by s. 320.06 which, in
697 lieu of the registration license number prescribed by s. 320.06,
698 is stamped with the words “Vietnam War Veteran” and a likeness
699 of the Vietnam Service Medal, followed by the registration
700 license number of the plate. Proof that the applicant was
701 awarded the Vietnam Service Medal is sufficient to establish
702 eligibility for the license plate.
703 (6) The owner or lessee of an automobile or truck for
704 private use, a truck weighing not more than 7,999 pounds, or a
705 recreational vehicle as specified in s. 320.08(9)(c) or (d)
706 which is not used for hire or commercial use who is a resident
707 of this state and a current or former member of the United
708 States military who was deployed and served in Saudi Arabia,
709 Kuwait, or another area of the Persian Gulf during Operation
710 Desert Shield or Operation Desert Storm; in Afghanistan during
711 Operation Enduring Freedom; or in Iraq during Operation Iraqi
712 Freedom, upon application to the department accompanied by proof
713 of active membership or former active duty status during one of
714 these operations and payment of the license tax for the vehicle
715 as provided in s. 320.08, shall be issued a license plate as
716 provided by s. 320.06 which, in lieu of the registration license
717 number prescribed by s. 320.06, is stamped with the words
718 “Operation Desert Shield,” “Operation Desert Storm,” “Operation
719 Enduring Freedom,” or “Operation Iraqi Freedom,” as appropriate,
720 and a likeness of the related campaign medal followed by the
721 registration license number of the plate. Proof that the
722 applicant was awarded the Southwest Asia Service Medal, Iraq
723 Campaign Medal, Afghanistan Campaign Medal, or Global War on
724 Terrorism Expeditionary Medal is sufficient to establish
725 eligibility for the appropriate license plate.
726 (7) The owner or lessee of an automobile or truck for
727 private use, a truck weighing not more than 7,999 pounds, or a
728 recreational vehicle as specified in s. 320.08(9)(c) or (d)
729 which is not used for hire or commercial use who is a resident
730 of this state and a current or former member of the United
731 States military who was permanently assigned to occupation
732 forces in specific overseas locations during the Cold War
733 between May 9, 1945, and October 2, 1990, upon application to
734 the department accompanied by proof of active membership or
735 former active duty status during this period at one of these
736 locations and payment of the license tax for the vehicle as
737 provided in s. 320.08, shall be issued a license plate as
738 provided by s. 320.06 which, in lieu of the registration license
739 number prescribed by s. 320.06, is stamped with the words “Army
740 of Occupation” and a likeness of the subject medal, followed by
741 the registration license number of the plate. Proof that the
742 applicant was awarded the Army of Occupation Medal is sufficient
743 to establish eligibility for the license plate.
744 Section 5. This act shall take effect October 1, 2021.
