House Comm: RCS . 02/16/2021 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Criminal Justice (Garcia) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 273 - 320 4 and insert: 5 staff and domestic violence advocates, as defined in s. 6 90.5036(1)(b), of domestic violence centers certified by the 7 Department of Children and Families under chapter 39; the names, 8 home addresses, telephone numbers, places of employment, dates 9 of birth, and photographs of the spouses and children of such 10 personnel; and the names and locations of schools and day care 11 facilities attended by the children of such personnel are exempt 12 from s. 119.07(1) and s. 24(a), Art. I of the State 13 Constitution. 14 3. An agency that is the custodian of the information 15 specified in subparagraph 2. and that is not the employer of the 16 officer, employee, justice, judge, or other person specified in 17 subparagraph 2. shall maintain the exempt status of that 18 information only if the officer, employee, justice, judge, other 19 person, or employing agency of the designated employee submits a 20 written request for maintenance of the exemption to the 21 custodial agency. 22 4. An officer, an employee, a justice, a judge, or other 23 person specified in subparagraph 2. may submit a written request 24 for the release of his or her exempt information to the 25 custodial agency. The written request must be notarized and must 26 specify the information to be released and the party that is 27 authorized to receive the information. Upon receipt of the 28 written request, the custodial agency shall release the 29 specified information to the party authorized to receive such 30 information. 31 5. The exemptions in this paragraph apply to information 32 held by an agency before, on, or after the effective date of the 33 exemption. 34 6. This paragraph is subject to the Open Government Sunset 35 Review Act in accordance with s. 119.15 and shall stand repealed 36 on October 2, 2024, unless reviewed and saved from repeal 37 through reenactment by the Legislature. 38 Section 2. The Legislature finds that it is a public 39 necessity that the home addresses, telephone numbers, places of 40 employment, dates of birth, and photographs of current or former 41 staff and domestic violence advocates, as defined in s. 42 90.5036(1)(b), of domestic violence centers certified by the 43 Department of Children and Families under chapter 39; the names, 44 home addresses, telephone numbers, places of employment, dates 45 of birth, and photographs of the spouses and children of such 46 personnel; and the names and locations of schools and day care 47 facilities attended by the children of such personnel be exempt 48 from public records requirements. Such personnel and their 49 family members are at a heightened risk of physical and 50 emotional harm from perpetrators of domestic violence who have 51 contentious reactions to actions taken by such personnel to 52 house and protect victims of domestic violence and limit further 53 harm to such victims.
