Florida Senate - 2021 SB 7026 By the Committee on Regulated Industries 580-02166-21 20217026__ 1 A bill to be entitled 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 548.062, F.S., relating 4 to an exemption from public records requirements for 5 proprietary confidential business information obtained 6 through an audit of a promoter’s books and records or 7 provided by a promoter to the Florida State Boxing 8 Commission; removing the scheduled repeal of the 9 exemption; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 548.062, Florida Statutes, is amended to 14 read: 15 548.062 Public records exemption.— 16 (1) As used in this section, the term “proprietary 17 confidential business information” means information that: 18 (a) Is owned or controlled by the promoter; 19 (b) The promoter intends to be and treats as private; 20 (c) If disclosed, would cause harm to the promoter or its 21 business operations; 22 (d) Has not been disclosed, except for any disclosure 23 pursuant to a statutory provision, an order of a court or 24 administrative body, or a private agreement that provides that 25 the information not be released to the public; and 26 (e) Concerns any of the following: 27 1. The number of ticket sales for a match; 28 2. The amount of gross receipts after a match; 29 3. A trade secret, as defined in s. 688.002; 30 4. Business plans; 31 5. Internal auditing controls and reports of internal 32 auditors; or 33 6. Reports of external auditors. 34 (2) Proprietary confidential business information provided 35 by a promoter to the commission or obtained by the commission 36 through an audit of the promoter’s books and records pursuant to 37 s. 548.06 is confidential and exempt from s. 119.07(1) and s. 38 24(a), Art. I of the State Constitution. Information made 39 confidential and exempt by this subsection may be disclosed to 40 another governmental entity in the performance of its duties and 41 responsibilities. 42(3) This section is subject to the Open Government Sunset43Review Act in accordance with s. 119.15 and shall stand repealed44on October 2, 2021, unless reviewed and saved from repeal45through reenactment by the Legislature.46 Section 2. This act shall take effect October 1, 2021.
