Florida Senate - 2021 SB 7036 By the Committee on Agriculture 575-02382-21 20217036__ 1 A bill to be entitled 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 570.077, F.S., which 4 provides an exemption from public records requirements 5 for criminal or civil intelligence or investigative 6 information or any other information held by the 7 Department of Agriculture and Consumer Services as 8 part of an examination or investigation with another 9 state or federal regulatory, administrative, or 10 criminal justice agency; removing the scheduled repeal 11 of the exemption; providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Section 570.077, Florida Statutes, is amended to 16 read: 17 570.077 Confidentiality of intelligence or investigative 18 information.— 19 (1) Criminal or civil intelligence or investigative 20 information or any other information held by the department as 21 part of a joint or multiagency examination or investigation with 22 another state or federal regulatory, administrative, or criminal 23 justice agency which is confidential or exempt under the laws or 24 regulations of that state or federal agency is confidential and 25 exempt from s. 119.07(1) and s. 24(a), Art. I of the State 26 Constitution. The department may obtain, use, and release the 27 information in accordance with the conditions imposed by the 28 joint or multiagency agreement. 29 (2) The department may release information that is made 30 confidential and exempt under subsection (1): 31 (a) In the furtherance of its official duties and 32 responsibilities. 33 (b) To another governmental agency in the furtherance of 34 its official duties and responsibilities. 35 (3) The public records exemption provided in subsection (1) 36 does not apply to information held by the department as part of 37 an independent examination or investigation conducted by the 38 department. 39(4) This section is subject to the Open Government Sunset40Review Act in accordance with s. 119.15 and shall stand repealed41on October 2, 2021, unless reviewed and saved from repeal42through reenactment by the Legislature.43 Section 2. This act shall take effect October 1, 2021.
