Florida Senate - 2021 SB 7042 By the Committee on Agriculture 575-02389-21 20217042__ 1 A bill to be entitled 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 601.10, F.S., which 4 provides a public records exemption for trade secret 5 information provided to the Department of Citrus; 6 removing the scheduled repeal of the exemption; 7 providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsection (8) of section 601.10, Florida 12 Statutes, is amended to read: 13 601.10 Powers of the Department of Citrus.—The department 14 shall have and shall exercise such general and specific powers 15 as are delegated to it by this chapter and other statutes of the 16 state, which powers shall include, but are not limited to, the 17 following: 18 (8)(a) To prepare and disseminate information of importance 19 to citrus growers, handlers, shippers, processors, and industry 20 related and interested persons and organizations relating to 21 department activities and the production, handling, shipping, 22 processing, and marketing of citrus fruit and processed citrus 23 products. For referendum and other notice and informational 24 purposes, the department may prepare and maintain, from the best 25 available sources, a citrus grower mailing list. Such list shall 26 be a public record available as other public records but is not 27 subject to the purging provisions of s. 283.55. 28 (b) Any information provided to the department which 29 constitutes a trade secret as defined in s. 812.081 is 30 confidential and exempt from s. 119.07(1) and s. 24(a), Art. I 31 of the State Constitution.This paragraph is subject to the Open32Government Sunset Review Act in accordance with s. 119.15 and33shall stand repealed on October 2, 2021, unless reviewed and34saved from repeal through reenactment by the Legislature.35 (c) Any nonpublished reports or data related to studies or 36 research conducted, caused to be conducted, or funded by the 37 department under s. 601.13 is confidential and exempt from s. 38 119.07(1) and s. 24(a), Art. I of the State Constitution. 39 Section 2. This act shall take effect October 1, 2021.
