House Comm: WD . 03/08/2021 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Children, Families, and Elder Affairs (Taddeo) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete everything after the enacting clause 4 and insert: 5 Section 1. Subsection (10) of section 393.065, Florida 6 Statutes, is redesignated as subsection (11), and a new 7 subsection (10) is added to that section to read: 8 393.065 Application and eligibility determination.— 9 (10)(a) Regardless of whether an applicant is eligible to 10 receive waiver services, the agency shall provide the following 11 information to the applicant or his or her parent, legal 12 guardian, or family member: 13 1. A brief overview of the vocational rehabilitation 14 services offered through the Florida Division of Vocational 15 Rehabilitation, including a hyperlink or website address that 16 provides access to the applicable application for such services. 17 2. A brief overview of the Florida ABLE program as 18 established under s. 1009.986, including a hyperlink or website 19 address that provides access to the application for establishing 20 an ABLE account as defined in s. 1009.986(2). 21 3. A brief overview of the supplemental security income 22 benefits and social security disability income benefits 23 available under Title XVI of the Social Security Act, as 24 amended, including a hyperlink or website address that provides 25 access to the applicable application for such benefits. 26 4. A statement indicating that the applicant’s local public 27 school district may provide specialized instructional services, 28 including transition programs, for students with special 29 education needs. 30 5. A brief overview of programs and services funded through 31 the Center for Students with Unique Abilities, including contact 32 information for each state approved Florida Postsecondary 33 Comprehensive Transition Program. 34 6. A brief overview of decision-making options for 35 individuals with disabilities, which may include contact 36 information for organizations that the agency bieleves helpful 37 in assisting with such decisions. 38 7. A brief overview of the referral tools made available 39 through the agency, including a hyperlink or website address 40 that provides access to such tools. 41 8. A statement indicating that some waiver providers may 42 serve private pay individuals. 43 (b) The agency must provide the information required in 44 paragraph (a) in writing to an applicant or his or her parent, 45 legal guardian, or family member along with a written disclosure 46 statement in substantially the following form: 47 48 DISCLOSURE STATEMENT 49 50 Each program and service has its own eligibility requirements. 51 By providing the information specified in s. 393.065(10)(a), the 52 agency does not guarantee an applicant’s eligibility for or 53 enrollment in any program or service. 54 Section 2. This act shall take effect July 1, 2021. 55 ================= T I T L E A M E N D M E N T ================ 56 And the title is amended as follows: 57 Delete everything before the enacting clause 58 and insert: 59 A bill to be entitled 60 An act relating to resource information for 61 individuals with disabilities; amending s. 393.065, 62 F.S.; requiring the Agency for Persons with 63 Disabilities to provide specified written information 64 to persons applying for certain waiver services; 65 requiring the agency to provide a certain disclosure 66 statement along with such information; providing an 67 effective date.
