       The Committee on Judiciary (Thurston) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete line 205
    4  and insert:
    5  whichever is later. This section does not apply to a cause of
    6  action brought against a health care provider that has been
    7  cited by a state or federal agency for one or more infection
    8  prevention and control deficiencies during any of the 3 years
    9  preceding the date of the State Surgeon General’s declaration of
   10  the state public health emergency relating to COVID-19.
