       Senator Powell moved the following:
       
    1         Senate Amendment to Senate Amendment (910316) to House
    2  Amendment (with title amendment)
    3  
    4         Between lines 1213 and 1214
    5  insert:
    6         Section 33. Present subsections (2), (3), and (4) of
    7  section 106.19, Florida Statutes, are redesignated as
    8  subsections (3), (4), and (5), respectively, present subsection
    9  (2) is amended, and a new subsection (2) is added to that
   10  section, to read:
   11         106.19 Violations by candidates, persons connected with
   12  campaigns, and political committees.—
   13         (2)Any candidate; campaign manager, campaign treasurer, or
   14  deputy treasurer of any candidate; committee chair, vice chair,
   15  campaign treasurer, deputy treasurer, or other officer of any
   16  political committee; agent or person acting on behalf of any
   17  candidate, political committee, or political party; or other
   18  person who knowingly and willfully:
   19         (a)Solicits, influences, or induces any individual to file
   20  as a candidate whom does not use her or his best efforts and
   21  skill or does not strive earnestly to win election or does not
   22  use, or is prevented from using, her or his best efforts and
   23  skill as a result of coercion, bribery, duress, threats, reward
   24  or promise thereof, physical incapacity or disability,
   25  suggestion or agreement, or any other improper or unlawful
   26  means; or
   27         (b)Acts on behalf of any individual who files as a
   28  candidate whom does not use her or his best efforts and skill or
   29  does not strive earnestly to win election or does not use, or is
   30  prevented from using, her or his best efforts and skill as a
   31  result of coercion, bribery, duress, threats, reward or promise
   32  thereof, physical incapacity or disability, suggestion or
   33  agreement, or any other improper or unlawful means;

   35  is guilty of a felony of the third degree, punishable as
   36  provided in s. 775.082 or s. 775.083.
   37         (3)(2) Any candidate, campaign treasurer, or deputy
   38  treasurer; any chair, vice chair, or other officer of any
   39  political committee; any agent or person acting on behalf of any
   40  candidate, or political committee, or political party; or any
   41  other person who violates paragraph (1)(a), paragraph (1)(b), or
   42  paragraph (1)(d), or subsection (2) shall be subject to a civil
   43  penalty equal to three times the amount involved in the illegal
   44  act. Such penalty may be in addition to the penalties provided
   45  by subsection (1) or subsection (2) and shall be paid into the
   46  General Revenue Fund of this state.

   51  insert:
   52         amending s. 106.19, F.S.; prohibiting certain persons
   53         from soliciting, influencing, or inducing a certain
   54         individual to file as a candidate for office or from
   55         acting on behalf of such persons; providing civil and
   56         criminal penalties;
